City Council meeting of April 4, 2005 <br />Page 5 <br />AND DEVELOPMENT AGREEMENT FOR WATER EDGE SOUTH 2ND ADDITION. <br />VOTING AYE: Granger, Haas, Petryk, Puleo, Miron <br />Motion Carried. <br />APPROVE FINAL PLAT AND DEVELOPMENT AGREEMENT FOR WATERS EDGE 3RD <br />ADDITION (PULTE) <br />Pulte Homes requested approval of a final plat and development agreement for Waters Edge Third <br />Addition for 106 Village townhome units on 23.96 acres located east of Everton Avenue North in the <br />northeast quadrant of Section 18, T31 N, R21 W. <br />Puleo made motion, Petryk seconded, to adopt RESOLUTION 2005-17 APPROVING THE FINAL <br />PLAT AND DEVELOPMENT AGREEMENT FOR WATERS EDGE 3RD ADDITION. <br />VOTING AYE: Granger, Haas, Petryk, Puleo, Miron <br />Motion Carried. <br />APPROVE EXTENSION OF WATERS EDGE TEMPORARY SALES TRAILER UNTIL <br />OCTOBER 30, 2005 <br />Pulte Homes has had a sales trailer on the Wagner's Greenhouse property since August 13, 2004. <br />According to the approving resolution for Water's Edge, the sales trailer had to be removed within nine <br />months, meaning that the trailer should be removed from the site on or before May 13, 2005. At that <br />time, the expectation was that Pulte would relocate the office into their model homes or clubhouse. <br />Pulte requested an extension until October 30, 2005 in order to allow time for the clubhouse and model <br />homes to be completed. Approval is subject to an extension of a right-of-way permit from Washington <br />County, which is expected due to the delay in the construction of the CSAH 8/14 project. <br />Haas made motion, Granger seconded, to approve the extension of the temporary sales trailer until <br />October 30, 2005, subject to discussion with Washington County about striping for turn lanes adjacent <br />to the trailer's entrance. <br />All aye. Motion Carried. <br />PROPOSED LEGISLATION FOR 10 -YEAR EQUIPMENT CERTIFICATES <br />At its February 7, 2005 meeting, Council discussed whether to propose new legislation for 10 -year <br />equipment certificates, from the current state statute of five years. Council stated that they were not <br />interested in a change in legislation at this time and voted unanimously to table the issue. Since that <br />meeting, State Representative Ray Vandeveer scheduled a hearing with the Metro Governance <br />Committee and a new bill for 10 -year equipment certificates was heard, at which Fire Chief Jim <br />Compton testified. The new bill passed and was referred to the committee. Jim prepared a background <br />letter with a timeline of events relating to this issue, and was present at the meeting to discuss them <br />with Council. After discussion, it was the consensus of the Council to maintain a neutral position. <br />
