No formal Council action was taken. <br />UPDATE ON WASHINGTON COUNTY'S OFFER TO PURCHASE ROW FOR CSAH 8/14 <br />PROJECT <br />City staff received notification from Washington County that the purchase agreement offers made to <br />private property owners have been made public, and offers are subject to a 30 -negotiating period. City <br />Attorney Dave Snyder provided an update on the right-of-way acquisition process for CSAH 8 and <br />Oneka Parkway. No formal Council action was taken. <br />REVIEW BESA CONDITIONAL USE PERMIT CITIZEN APPEAL TO BOARD OF ZONING <br />APPEALS <br />At its April 14, 2005 meeting, the Board of Zoning -Appeals discussed a citizen appeal to the City <br />Council's approval of a CUP for the Bald Eagle Sportsman Association (BESA) to conduct its activities <br />and operation for 2005. The specific appeal is to discuss the approval for the use of lights by the BESA <br />for a three week period in the fall. The Board's decision was a 2-0 vote, with Board member Frank <br />Puleo abstaining from the vote due to his membership in the BESA; specifically, the Board upheld the <br />City decision two years ago to allow the use of lights and determined that it was not an expansion of use. <br />CD Director Bryan Bear continued to meet with BESA officials and neighbors to reach a solution <br />amenable to both parties. Bryan provided Council with an update of the April 27, 2005 meeting held <br />with residents and Mayor Miron, as well as actions taken and completed by BESA to comply with <br />original direction from the City. This issue was continued from the May 2, 2005 Council agenda at the <br />request of homeowners living in Dellwood Ridge in order to allow for a meeting between neighborhood <br />representatives and the gun club. The meeting was held at City Hall on May 11, 2005 and Bryan <br />provided Council of the current status of the application with a Power Point presentation. Kevin <br />Rhodes, neighborhood representative, provided his facts and opinion as to why the City should have held <br />a public hearing to consider the use of lights and why City approval should be considered an expansion <br />of a non -conforming use. Council has until June 15, 2005 in which to make a decision in this matter as <br />per the 60 -day state statute. City Attorney Dave Snyder stated that the City Council has four options to <br />consider regarding whether to grant the appeal: 1) approve appeal; 2) deny appeal; 3) yes or no as to <br />expansion of use; and 4) take comments and table action to June 6, 2005 regular Council meeting. <br />Miron made motion, Granger seconded, directing staff to prepare Findings of Fact for approval and <br />Findings of Fact for denial and encourage both sides of the issue to meet independently or collaborate in <br />an effort to resolve the conflict, and present to Council at its meeting of June 6, 2005. <br />VOTING AYE: Granger, Haas, Petryk, Miron <br />ABSTAINED: Puleo <br />Motion Carried. <br />CITIZEN APPOINTMENTS TO RICE CREEK WATERSHED DISTRICT TMDL TASK <br />FORCE <br />Mayor Fran Miron was informed by Steve Hobbs, RCWD administrator, that the district seeks citizens <br />who wish to serve on an advisory committee for the purpose of reviewing the issue of TMDL, which is <br />
