City Council meeting of August 1, 2005 <br />Page 4 <br />APPROVE LEASE AGREEMENT TO T -MOBILE FOR TOWER #3 <br />Staff has been working with T -Mobile for the past year to locate cellular antennas on the City's Water <br />Tower #3. Public Works Director Chris Petree and City Attorney Dave Snyder have reviewed the site <br />plan and the lease agreement and found them to satisfactorily meet the City's requirements. As part of <br />this lease agreement, staff has negotiated a $1500/month lease rate with T -Mobile to locate on Water <br />Tower #3. Adoption of the Consent Agenda approved the lease agreement with T -Mobile. <br />APPROVE CIGARETTE LICENSE FOR 13997 FOREST BLVD (MAI YER MOUA) <br />Mai Yer Moua, 7614 137d' Street North, applied for a cigarette license for 13997 Forest Boulevard North <br />(Nadeau's Market). Adoption of the Consent Agenda approved the cigarette license for 13997 Forest <br />Boulevard. <br />APPROVE ADOPTION OF NIMS RESOLUTION <br />Adoption of the Consent Agenda adopted Resolution 2005-42 designating NIMS as the City of Hugo's <br />emergency management system. <br />APPROVE OFF SALE 3.2 BEER LICENSE FOR 13997 FOREST BLVD (MAI YER MOUA) <br />Mai Yer Moua, 7614 137' Street North, applied for a 3.2 Beer License for 13997 Forest Boulevard <br />North (Nadeau's Market). Council member Frank Puleo questioned whether issuance of the license <br />affected the number of liquor licenses available in the City. He was informed that only on -sale liquor <br />licenses are limited. <br />Puleo made motion, Granger seconded, to approve the off -sale 3.2 beer license for Mai Yer Moua at <br />13997 Forest Boulevard. <br />All aye. Motion Carried. <br />PROPOSED TOWER (CINGULAR WIRELESS) — PUBLIC HEARING <br />At its meeting of July 18, 2005, Council scheduled a public hearing for August 1, 2005, to continue <br />public discussion regarding the application from Cingular Wireless Communications for installation of <br />190 ft tower at 15380 Keystone Avenue. The purpose of the public hearing is to provide the applicant an <br />opportunity to demonstrate further site location alternatives for the tower. At this time, there has been <br />no new information submitted and the applicant is requesting extension until September 6, 2005. City <br />Attorney Dave Snyder stated that the City received a Withdrawal of Application from Cingular Wireless <br />Agent, Debra Weiss, and he recommended Council accept the withdrawal request. <br />Miron made motion, Petryk seconded, to adopt RESOLUTION 2005-43 ACCEPTING <br />WITHDRAWAL OF APPLICATION REQUEST FROM CINGULAR WIRELESS <br />COMMUNICATIONS FOR 15380 KEYSTONE AVENUE. <br />VOTING AYE: Granger, Petryk, Puleo, Miron Motion Carried. <br />
