City Council meeting of August 1, 2005 Page 4 APPROVE LEASE AGREEMENT TO T -MOBILE FOR TOWER #3 Staff has been working with T -Mobile for the past year to locate cellular antennas on the City's Water Tower #3. Public Works Director Chris Petree and City Attorney Dave Snyder have reviewed the site plan and the lease agreement and found them to satisfactorily meet the City's requirements. As part of this lease agreement, staff has negotiated a $1500/month lease rate with T -Mobile to locate on Water Tower #3. Adoption of the Consent Agenda approved the lease agreement with T -Mobile. APPROVE CIGARETTE LICENSE FOR 13997 FOREST BLVD (MAI YER MOUA) Mai Yer Moua, 7614 137d' Street North, applied for a cigarette license for 13997 Forest Boulevard North (Nadeau's Market). Adoption of the Consent Agenda approved the cigarette license for 13997 Forest Boulevard. APPROVE ADOPTION OF NIMS RESOLUTION Adoption of the Consent Agenda adopted Resolution 2005-42 designating NIMS as the City of Hugo's emergency management system. APPROVE OFF SALE 3.2 BEER LICENSE FOR 13997 FOREST BLVD (MAI YER MOUA) Mai Yer Moua, 7614 137' Street North, applied for a 3.2 Beer License for 13997 Forest Boulevard North (Nadeau's Market). Council member Frank Puleo questioned whether issuance of the license affected the number of liquor licenses available in the City. He was informed that only on -sale liquor licenses are limited. Puleo made motion, Granger seconded, to approve the off -sale 3.2 beer license for Mai Yer Moua at 13997 Forest Boulevard. All aye. Motion Carried. PROPOSED TOWER (CINGULAR WIRELESS) — PUBLIC HEARING At its meeting of July 18, 2005, Council scheduled a public hearing for August 1, 2005, to continue public discussion regarding the application from Cingular Wireless Communications for installation of 190 ft tower at 15380 Keystone Avenue. The purpose of the public hearing is to provide the applicant an opportunity to demonstrate further site location alternatives for the tower. At this time, there has been no new information submitted and the applicant is requesting extension until September 6, 2005. City Attorney Dave Snyder stated that the City received a Withdrawal of Application from Cingular Wireless Agent, Debra Weiss, and he recommended Council accept the withdrawal request. Miron made motion, Petryk seconded, to adopt RESOLUTION 2005-43 ACCEPTING WITHDRAWAL OF APPLICATION REQUEST FROM CINGULAR WIRELESS COMMUNICATIONS FOR 15380 KEYSTONE AVENUE. VOTING AYE: Granger, Petryk, Puleo, Miron Motion Carried.
