City Council meeting of October 17, 2005 <br />Page 4 <br />Fawcett with a lawsuit against the MnDNR, filed by George and Kathy Schtowchan. The lawsuit cites a <br />request to intervene in the lawsuit filed against the City of Hugo and RCWD by the MnDNR. City <br />Attorney Dave Snyder provided additional information about the lawsuit. Council member Puleo <br />questioned the status of the City's effort to eliminate the DNR's Cease and Desist Order and assurances <br />that the City will be able to continue its minor ditch and culvert maintenance. <br />Puleo made motion, Petryk seconded, that the City Council be informed of any discussion or <br />correspondence regarding JD2/Rice Lake level, and that any meeting held regarding these matters cannot <br />be held unless attended by either Council member Frank Puleo or Council member Mike Granger. <br />All aye. Motion Carried. <br />Mayor Fran Miron returned to the meeting. Council member Puleo questioned the City's ability to <br />maintain the culverts at 157' Street and 165' Street due to safety concerns. It was City Attorney Dave <br />Snyder's opinion that the DNR's Cease and Desist Order does not prohibit the City from maintaining the <br />culverts. <br />Miron made motion, Puleo seconded, directing staff to install guard rails, if feasible, at 157' Street <br />culvert. <br />All aye. Motion Carried. <br />Puleo made motion, Granger seconded, directing staff to look at the 165' Street culvert location and <br />report to Council a recommendation for road safety. <br />All aye. Motion Carried. <br />SCHEDULE JOINT COUNCIL/EDA WORKSHOP FOR NOVEMBER 21, 2005 <br />At its October 17, 2005 meeting, the EDA discussed the work completed to date with the TIF <br />Subcommittee, including the research and development of a downtown tax increment financing district. <br />With a significant amount of research and preparatory work completed, it is necessary to schedule a joint <br />Council/EDA workshop in order to review and make final decisions on the future direction of the <br />proposed downtown TIF district. <br />Miron made motion, Granger seconded, to schedule a joint Council/EDA workshop on Monday, <br />November 21, 2005, at 8:30 am, in order to discuss the proposed downtown TIF district. <br />All aye. Motion Carried. <br />DISCUSS WASHINGTON COUNTY CDBG PROGRAM <br />City staff has received information from Washington County and its Community Development Block <br />Grant Program. As Council is aware, the City of Hugo submitted a CDBG application last year for <br />funding the purchase and site improvements for the Carpenters restaurant and old antique store. The <br />competition for CDBG grant funds was overwhelming and the City's grant application was unsuccessful. <br />
