City Council meeting of January 5, 2004 <br />Page 8 <br />located at 9745 140" Street. Staff spoke to Brian Woltz from FEMA, who stated that the next step in <br />the grant procedure is the development of a sub -grant agreement, which would then be forwarded to <br />the City for approval, along with a work plan that would incorporate the purchase of, demolition of, <br />and final work for the Don and Pauline Rice property. City Attorney Dave Snyder drafted a Grant <br />Agreement by which the City would use in finalizing the purchase of the Rice property. Council <br />discussed several options for use of the property, including public access, sell to adjoining property <br />owner, or wetland mitigation property. <br />Granger made motion, Haas seconded, directing staff and City Engineer to review pros and cons to all <br />options for use of the Rice property and report to City Council. <br />All aye. Motion Carried. <br />APPROVE PRELIMINARY PLAT. PUD & REZONING FOR NORTHERN PINES <br />SUBDIVISION (MASTERPIECE. INC.) <br />Masterpiece Homes, Inc requested to rezone to PUD, PUD general plan, and preliminary plat approval <br />for the development to be known as "Northern Pines". The property is located east of Highway 61 and <br />north of 125" Street (former Jespersen strawberry patch). Northern Pines will consist of 38 twinhomes <br />on the 12.3 acre parcel. The Planning Commission considered this request at its meeting on December <br />11, 2003 and unanimously recommended approval. City Planner Kendra Lwdahl provided a Power <br />Point overview of the project. Council discussed driveway parking, street parking, as well as the need <br />for a sidewalk. Developer Gordy Howe listened to Council concerns and stated that he could <br />incorporate no parking on the west side of the street, and install a sidewalk on the west side as well. <br />Haas made motion, Granger seconded, to adopt ORDINANCE 2004-383 AMENDING CHAPTER <br />320 TO CLASSIFY CERTAIN LAND FROM R-3 TO PUD (NORTHERN PINES). <br />VOTING AYE: Granger, Haas, Petryk, Puleo, Miron <br />Motion Carried. <br />Haas made motion, Puleo seconded, to adopt RESOLUTION 20043 APPROVING FINDINGS OF <br />FACT FOR "NORTHERN PINES". <br />VOTING AYE: Granger, Haas, Petr*, Puleo, Miron <br />Motion Carried. <br />Haas made motion, Petryk seconded, to adopt RESOLUTION 2004-4 APPROVING A PUD <br />GENERAL PLAN FOR "NORTHERN PINES". <br />VOTING AYE: Granger, Haas, Petryk, Puleo, Miron <br />Motion Carried. <br />This approval is subject to incorporation of the following issues into the Development Agreement: 1) <br />homeowners' association restrictions on driveway parking; 2) include sidewalk and parking on west <br />side of street; 3) escrow for urban street with credit for rural section; and 4) submittal -of a tree <br />
