City Attorney Dave Snyder prepared a letter City <br />regarding the legal costs involved, if the City desires to proceed with legal means to collect the TIF <br />shortfall. Finance Director Ron Otkin also prepared an analysis of the collection of TIF revenue in the <br />BEIP, and the projected amount that would be returned to Washington County in the future. CD <br />Director John Rask prepared a memo that outlines options for consideration by Council. Council <br />member requested "internal" discussion of the situation prior to meeting with the business owners. <br />Miron made motion, Haas seconded, to schedule a Council workshop to discuss the BEIP tax increment <br />financing shortfall for Friday, June 13, 2003, Hugo City Hall, at 8:00 am. <br />All aye. Motion Carried. <br />SALE OF JIM LEMOINE PROPERTY FOR PARKLAND <br />In October 2002, the Council considered a proposal from Jim LeMoine, who lives at 14451 Homestead <br />Avenue, requesting approval of a buildable homesite on his property. The Planning Commission <br />recommended that the request be denied and the Council approved the denial of the buildable lot <br />application. Mr. LeMoine would like to sell his land to the City for parkland /open space and CD <br />Director John Rask provided a memo explaining the request. <br />Haas made motion, Miron seconded, directing staff to negotiate a purchase price with Jim LeMoine in <br />the $25,000 to $30,000 range. <br />All aye. Motion Carried. <br />MIKE ATKINSON DRAINAGE PROBLEM ON TH61 <br />At its May 5, 2003 meeting, the Council discussed a drainage issue raised by Mike Atkinson regarding <br />the TH61 and 140th Street traffic signal project. Mr. Atkinson met on site with Mayor Miron and <br />Council member Granger requesting that the ditch be filled in on his property immediately adjacent to <br />TH61. City staff was directed to analyze the engineering aspects of filling in of the very deep ditch, and <br />complete the work, if it did not exceed $10,000. Engineering tech Brian Mitchell met with Mike <br />Atkinson on site to discuss the issue to better understand the desires of Mr. Atkinson. SEH reviewed the <br />options to meet Mr. Addnson's request and have found that it is unlikely that the work necessary can be <br />completed for the $10,000 authorized by Council. The primary cost concern is the existence of an <br />existing water valve and hydrant on the alignment that would have to be relocated to install a pipe in the <br />existing ditch. Additionally, surface drainage in the area would be hampered as a result of modifications <br />and would create a situation of standing water on the surface. It is not possible to construct a drainage <br />structure over the new pipe because it is to shallow. Brian Mitchell discussed this with Mr. Atkinson, <br />and he continues to desire that the ditch be filled. City staff recommended that Council consider the <br />original engineered design of the project to leave the drainage "as is" in front of Mr. Addnson's property. <br />City staff would propose to work with Mr. Atkinson to grade the ditch to a more acceptable cross section <br />making it easier for him to maintain, which seems to be his primary concern. City Engineer Mitchell <br />stated why alterations to the ditch would cost more than the approved $10,000; a more realistic amount <br />being $15,000. Mr. Atkinson addressed the Council and expressed his displeasure with the engineering <br />recommendation. CD Director John Rask thought it would be prudent for the City to approach MnDOT <br />
