City Council meeting of August 5, 2002 <br />Page 10 <br />in a plat to be known as "Legacy % The subject plat would be located on the former McCollar property <br />directly west of Centex's recently approved Clearwater Creek project. The lots adjacent to the Centex <br />project and east of Clearwater Creek would consist of "detached" townhomes. The remaining lots <br />would be large executive home sites averaging approximately one acre in size. Pratt Homes would be <br />the exclusive builder in this development. The Planning Commission held a public hearing on July 11, <br />2002 to review the application, and recommended approval by a unanimous vote. <br />Haas made motion, Granger seconded, to adopt ORDINANCE 2002-363, AN ORDINANCE <br />AMENDING CHAPTER 320 ENTITLED ZONING BY THE ZONING CLASSIFICATION OF <br />CERTAIN DEFINED PROPERTY. <br />VOTING AYE: Granger, Haas, Petryk, Puleo, Miron <br />Motion Carried. <br />Haas made motion, Miron seconded, to adopt RESOLUTION 2002-39 APPROVING FINDINGS OF <br />FACT FOR REZONING PROPERTY LOCATED EAST OF ELMCREST AVE, WEST OF FENWAY <br />BLVD, NORTH OF 136m STREET, AND SOUTH OF 1401 STREET. <br />All aye. Motion Carried. <br />Granger made motion, Petryk seconded, to adopt RESOLUTION 2002-40 APPROVING A PUD <br />GENERAL PLAN FOR PROPERTY LOCATED EAST OF ELMCREST AVE, WEST OF FENWAY <br />BLVD, NORTH OF 136m STREET, AND SOUTH OF 140TH STREET. <br />VOTING AYE: Granger, Haas, Petryk, Puleo, Miron <br />Motion Carried. <br />Haas made motion, Puleo seconded, to adopt RESOLUTION 2002-41 APPROVING A PRELIMINARY <br />PLAT FOR THE LEGACY SUBDIVISION. <br />VOTING AYE: Granger, Haas, Petryk, Puleo, Miron <br />Motion Carried. <br />PRELMUNARY PLAT FOR ONEKA LAKE VIEW SOUTH SUBDIVISION <br />Seth Marshall requested approval of a conditional use permit and preliminary plat to construct six <br />twinhomes south of Oneka Lake Boulevard. City staff recommended denial of the application because <br />the request fails to meet the ordinance requirements. Staff was particularly concerned with the access <br />onto Oneka Lake Boulevard. The Planning Commission held a public hearing on July 11, 2002 to <br />review the application and recommended denial by a unanimous vote. City staffrecommended that the <br />Council deny the application and adopt the findings of fact contained in the resolution attached to the <br />staff report. <br />Haas made motion, Petryk seconded, to adopt RESOLUTION 2002-42 APPROVING FINDINGS OF <br />FACT DENYING THE CUP AND PRELIMINARY PLAT FOR NORTH SUBURBAN <br />DEVELOPMENT FOR ONEKA LAKE VIEW SOUTH. <br />
