City Council meeting of June 4, 2001 <br />Page 7 <br />Haas made motion, Miron seconded, to adopt RESOLUTION 2001-21 APPROVING SITE PLAN <br />FOR THE CITY FOR PROPERTY LOCATED EAST OF FITZGERALD AVENUE, NORTH OF <br />146TH ST AND SOUTH OF 147TH STREET. <br />VOTING AYE: Granger, Haas, Petryk, Puleo, Miron <br />Motion Carried. <br />CLUSTER HOUSING ORDINANCE <br />At its May 21, 2001 meeting, the Council listened to representatives from Tomten Environmental <br />Design as they discussed the City's current cluster development ordinance and cluster development in <br />the rural areas of Hugo. Council provided some direction to the representatives who then went to the <br />May 23, 2001 Planning Commission meeting, where they presented their suggestions for an <br />amendment to the City's cluster housing ordinance. The PC was not receptive to the amendment to the <br />cluster housing ordinance and voted down the request. Staff recommends that Council consider the <br />PC lack of support for an amendment to the cluster housing ordinance, but also consider the <br />information shared at its May 21, 2001 Council meeting and the concepts presented at that time. <br />Councilman Granger stated that the City should look at cluster housing in the eastern part of the City <br />in the same way the Everton Avenue Study was conducted in the western portion of the City. <br />Miron made motion, Granger seconded, to deny the request for an amendment to the City's cluster <br />housing ordinance, and direct the City Attorney to draft a Findings of Fact. Staff shall move forward <br />with plans for a scope of work for fiuther discussion of this matter in late August 2001. <br />All aye. Motion Carried. <br />PLATTED PARCELS IN RURAL TAXING DISTRICT <br />City staff was informed by Washington County that a total of 663 platted parcels are currently in the <br />rural taxing district for pay 2002. The County should have, but did not, change the parcels from the <br />rural to urban taxing district as they were platted. Staff presented this issue to Council for public <br />disclosure and for direction as to how to proceed. A decision by Council should be made by <br />August 2001 to allow for a change for pay 2002. <br />Miron made motion, Haas seconded, directing staff to schedule a meeting with Joanne Helm <br />and draft a report with suggestions to prevent another occurrence, and change the taxing district for <br />parcels that the City is aware of. <br />All aye. Motion Carried. <br />INVOICE FROM JOHN SIMONETT FOR JD2 MEDIATION WORK <br />Retired Minnesota Supreme Court Justice John E. Simonett submitted an invoice in the amount of <br />$4,106.03 for the City's share for the mediation services provided by the law firm of Greene Espel for <br />mediation on the JD2 lawsuit. Attorney Paul Haik represented the City on this issue, and he has <br />refused to pay this invoice for services rendered until Judge Simonett responds to his letter asking for <br />
