City Council meeting of January 4, 1999 <br />Page 3 <br />expiration of the terms of Theodora Peltier and David Schumann, and one due to the resignation of <br />Ken Rubenzer, effective January 31, 1999. Mr. Rubenzer's term expires 12/31/99. <br />Leroux made motion, Barnes seconded, to reappoint Theodora Peltier and David Schumann to 4 - <br />years term on the Planning Commission. <br />Leroux and Barnes withdrew their motion to allow for an individual vote. <br />Leroux made motion, Barnes seconded, to reappoint David Schumann to a 4 -year term on the <br />Planning Commission. <br />VOTING AYE: Stoltzman Barnes, Leroux, Petryk <br />PRESENT NOT VOTING: Chuck Haas <br />Motion Carried. <br />Stoltzman made motion, Leroux seconded, to reappoint Theodora Peltier to a 4 -year term on the <br />Planning Commission. <br />VOTING AYE: Stoltzman Barnes, Leroux, Petryk <br />PRESENT NOT VOTING: Chuck Haas <br />Motion Carried. <br />AMENDMENT TO DEVELOPMENT AGREEMENT (CREEKVIEW PRESERVE) <br />Due to the final selection of a road -access point across Washington County Rail Authority's right-of- <br />way, the length of street and number of lots created, as a part of Phase 1 of the Creekview Preserve <br />development, increased. Adding to the number of lots being created as part of the phase requires <br />additional parkland dedication fees and sealcoat escrow to be paid by the developer. In addition, the <br />developer requested that the City accept the public improvements for the lots along Foxhill Avenue, <br />157th Street, and 157th Street Circle, without completing the public improvements along 157th <br />Street Way. Based on these conditions, the City Attorney prepared an amendment to the <br />Development Agreement for the Creekview Preserve subdivision. Staff recommended approval of <br />the amendment. <br />Barnes made motion, Petryk seconded, to approve the second Addendum to the Development <br />Agreement for the Creekview Preserve subdivision. <br />All aye. Motion Carried. <br />OAKSHORE PARK PUBLIC PUBLIC IMPROVEMENT PROJECT <br />At the City Council meeting of December 21, 1998, this matter was table for consideration until this <br />evening's meeting. The City has previously made assessments for the project against benefited <br />property. One assessment has been filed in district court within the time frame allowed for such <br />appeal. The next step in the project would be to direct the City Engineer to prepare plans and <br />
