City Council meeting of January 19, 1999 <br />Page 3 <br />Stoltzman made motion, Barnes seconded, to appoint Chuck Haas as the Council's representative on <br />the Parks Commission. <br />All aye. Motion Carried. <br />AUTOMOBILE RECYCLING APPLICATION (ARK) <br />Mr. Daniel Stewart, 13795 60th Street, Oak Park Heights, MN., dba Automotive Recycling <br />Kompany, applied for an Auto Dismantling License for 16813 Forest Boulevard; this is the site of the <br />old Modern Auto and Northside Auto facilities. The Council considered a report from the City <br />Administrator with recommended conditions for license approval. It was agreed that no license <br />would be issued until the required escrow was deposited, and Mr. Stewart signed a Stipulation <br />Agreement to settle an ongoing legal action regarding his operating without a license. <br />Barnes made motion, Haas seconded, to table this matter pending Mr. Stewart depositing the <br />required escrow and signing the Stipulation Agreement. <br />All aye. Motion Carried. <br />REQUEST FOR UM1W COST SHARING (BACKES COS.) <br />At the Council meeting of December 7, 1998, the City Council received a request from the Backes <br />Cos., developer of Creekview Preserve subdivision, for reimbursement of certain costs incurred in <br />extending 12" watermain along the east side of TH61, and increasing the depth of sanitary sewer <br />throughout their project to serve adjacent property. The Council considered the City's cost-sharing <br />policy, and the Engineer's benefit analysis on this request. The City received a petition from property <br />owners along TH61 objecting to any financial obligation as a result of extension of utilities for this <br />subdivision. Council member Barnes felt she needed more time to research the history of this issue. <br />Barnes made motion, Leroux seconded, to table this matter until the meeting of February 1, 1999. <br />All aye. Motion Carried. <br />DEER PARK ESTATES (CONDITIONS OF PRELIIVIINARY PLAT APPROVAL) <br />On December 28, 1998, the City Council approved the preliminary plat for the Deer Park Estates <br />subdivision, subject to an amended SUP. The Council reviewed draft Findings of Fact and Conditions <br />of plat approval for the subdivision, as well as an amended SUP. The conditions of preliminary plat <br />approval provided would act as a basis for development of the final plat for the project, as well as a <br />Development Agreement. Councilman Haas revisited whether a commercial business can be allowed <br />in a residential PUD, and if City Attorney, Greg Galler, would have a conflict of interest in <br />representing the City as he has represented the applicant relative to this matter in the past. It was <br />agreed that Stillwater City Attorney, Dave Magnuson, would provide legal representation for the City <br />in this matter. Haas also stated that the applicant will need to escrow PUD fee of $5,000 in order for <br />City to continue with the process. <br />
