City Council meeting of November 15, 1999 <br />Page 4 <br />140TH STREET/RICK'S LIQUOR DRAINAGE <br />The Council considered a request from ECI Building Contractors that the City participate in the <br />construction of a joint driveway to serve Rick's Liquor and the adjacent empty lot owned by the City, as <br />well as the City Engineer's response to the request. The Council also considered a letter from the City <br />Engineer recommending that the City consider installing a stormwater pipe along the south property lines <br />of those lots abutting 140th Street. The estimated City cost for these two projects is $29,587.65, with <br />funding available from the City's Bald Eagle Industrial Park improvement fund. The City Council may <br />wish to consider assessing a portion of this cost against the vacant lot owned by the City, especially <br />relating to the shared driveway cost. Tom Angus stated that the RCWD had verbally stated that the land <br />could be drained to the existing wetlands, then later changed their position, requiring that a pond be <br />constructed for runoff. Councilmember Barnes suggested that the City obtain a "no cost" easement along <br />the length of Rick's Liquor south property line in the event property to the east will need to connect to <br />the storm sewer. <br />Haas made motion, Leroux seconded, that the City accept the recommendation of the City Engineer to <br />share in the cost of the shared driveway with Rick's Liquor. <br />All aye. Motion Carried. <br />Barnes made motion, Leroux seconded, that the City Engineer be directed to perform engineering work <br />necessary to obtain a bid to construct storm sewer pipe along the south property line of Rick's Liquor <br />and obtain necessary permits. <br />All aye. Motion Carried. <br />ALLEGED LIQUOR LICENSE VIOLATION (CARPENTER'S) <br />The Council considered a letter from the City Attorney recording that a formal complaint has been <br />received regarding the sale of alcohol to an underage person at Carpenter's on October 20, 1999. This is <br />the second incident of under -age sale at Carpenter's in 1999, and as such, the staff recommended that the <br />Council hold a civil penalty hearing on December 20, 1999. <br />Barnes made motion, Stoltzman seconded, to hold a civil penalty hearing on December 20, 1999, at 7:00 <br />pm, to address allegations of the sale of alcohol to an underage permit at Carpenter's. <br />All aye. Motion Carried. <br />Staff requested that the Council set a special meeting for November 22, 1999 to continue work on the <br />City's year 2000 budget in preparation for the Truth in Taxation hearing scheduled for December 6, <br />1999. <br />Stoltzman made motion, Barnes seconded, to set a workshop for November 22, 1999, at 7:00 pm, to <br />
