City Council meeting of March 2, 1998 <br />Page 4 <br />Regulations for Individual Sewage Treatment Systems. In addition, the ordinance <br />implements a Metro Council mandate requiring that all individual sewage treatment <br />systems within the City be inspected at least once every three years. The public hearing <br />was called to order, with no oral or written comments on the matter. <br />Leroux made motion, Barnes seconded, to adopt ORDINANCE 1998-318, AN <br />ORDINANCE REPEALING THE EXISTING CHAPTER 263 IN ITS ENTIRETY <br />AND ADOPTING A REVISED INDIVIDUAL SEWAGE TREATMENT SYSTEM <br />ORDINANCE. <br />VOTING AYE: Arcand, Barnes, Goiffon, Leroux, Miron <br />Motion Carried. <br />AUTOMOBILE RECYCLING LICENSE (ARK) <br />On October 20, 1997, the Hugo City Council denied an auto recycling license to ARK, <br />d.b.a. 16813 Forest Blvd., for various violations of Hugo City Code, Chapter 130. <br />Subsequently, the City sued ARK to bring them into compliance with the City ordinance. <br />The District Court issued an order directing ARK to bring the property into compliance no <br />later than February 15, 1998. If ARK does not comply with the Court Order, they will be <br />enjoined from operating the junkyard or auto dismantling business on the site until a <br />proper license had been granted in accordance with City ordinance. Following the Court <br />Order, the City's Administrator and Attorney agreed to recommend allowing ARK to post <br />a bond to insure removal of the tires by November, 1998, if all other conditions of the <br />site's SUP and Chapter 130 were complied with. An inspection of the site was conducted <br />on February 25, 1998 by the City's Building Official to determine compliance with the <br />SUP and ordinance, with the following violations being observed: <br />1. There are 20 mobile homes located on the site. <br />2. The east half of the fence along the north property line is in a state of disrepair. <br />3. The site has been expanded to include the old Northside Auto site. <br />4. The fire lanes on the "north site" site are not in conformance with Chapter 130. <br />Dan Stewart and his attorney, Scott Martin, stated that they are making progress in <br />cleaning the site, and questioned just where they were not in compliance with City code. <br />Staff believes that ARK has not complied with the District Court Order, or a subsequent <br />verbal agreement with the City for bringing the site into compliance. <br />Miron made motion, Barnes seconded, directing the City Attorney to file an Affidavit with <br />District Court attesting to the fact that ARK is not in compliance with the Court Order, <br />and bar ARK from operating a junkyard or auto dismantling business on the site until a <br />proper license has been granted. <br />
