Councilman Goiffon asked if the study fee was reimbursable by state <br />aid; the fee will be reimbursed only if the project is undertaken. <br />Goiffon made motion, Leroux seconded, to order the feasibility report as proposed. <br />All aye. Motion Carried. <br />BALD EAGLE LAKE HUNTING REGULATIONS <br />At the Council meeting of September 8, 1998, the Council directed that the City publish notice that <br />hunting is not allowed on Bald Eagle Lake within the City of Hugo, based on State law does not <br />allowing shooting from open water or the discharge of firearms within 500' of an inhabited dwellings. <br />It was determined that there was no location within the City of Hugo, on Bald Eagle Lake, that would <br />allow hunting under these laws. Staff was informed by the local DNR conservation officer that the <br />rule prohibiting hunting within 500' from an inhabited dwelling does not apply to water bodies. In <br />order to afford equal protection to citizens on all lake shore within the City, the City's attorney <br />prepared a draft ordinance amending Chapter 264 of the City Code. Councilman Leroux requested <br />that the draft ordinance be amended by changing reference to "private" property in 264.03 to <br />"occupied". Chapter 264.02 will be amended from "bullets shot" to "projectiles discharged". <br />Leroux made motion, Goiffon seconded, to adopt ORDINANCE 1998-326, AN ORDINANCE <br />REPEALING THE EXISTING CHAPTER 264 AND REPLACING IT WITH A NEW CHAPTER <br />264 REGULATING THE SHOOTING OF FIREARMS WITHIN THE CITY. <br />VOTING AYE: Goiffon, Leroux <br />VOTING NAY: Barnes <br />ABSTAINED: Arcand, Miron <br />Motion Carried. <br />Barnes made motion, Miron seconded, that the above -adopted ordinance be published in the White <br />Bear Press and the Forest Lake Times, along with posting of signs, where appropriate. <br />All aye. Motion Carried. <br />PETITION FOR REMOVAL OF OBSTRUCTIONS IN HARDWOOD CREEK <br />The City Council requested staff prepare a petition for the RCWD requesting that they declare the <br />culverts on CR4 and Harrow Avenue as obstructions to the Creek, and was presented to the Council <br />at the meeting. Because of the joint meeting on September 22, 1998, among the City, Forest Lake <br />Township, and Washington County, and their involvement in the issue, the following motion was <br />made: <br />Leroux made motion, Goiffon seconded, to table action on the petition until after the joint meeting of <br />September 22, 1998. <br />All aye. Motion Carried. <br />
