City Council meeting of May 5, 1997 <br />Page 2 <br />stated that requests for variance are granted if it can be proved that the property cannot be <br />put to any reasonable use unless the variance is granted. Money issues are not considered <br />a hardship. <br />Barnes made motion, Miron seconded, to deny the variance request of Mr. Charles <br />Brimmer, 4908 120th Street, for construction of a 26' x 54' accessory building with an <br />exterior NOT similar to the residence. Denial is based on Findings of Fact to be prepared <br />by the City Attorney. <br />All aye. Motion Carried. <br />3.2 BEER/CIGARETTE LICENSES (L3OBBER' S BOATS AND BAIT) <br />Robert McElmury made application to the City for 3.2 beer and cigarette licenses for his <br />business located 4444 129th Street. Jim Kellison and Dave Pepin, neighbors of the <br />business, were present stating that Mr. McElmury has not complied with all conditions of <br />his SUP as follows: <br />1. Condition #3: A sign indicating hours of operation has not been posted. <br />2. Condition #6: Debris on the property. <br />3. Condition # 12: Only vegetative screening is one tree. <br />4. Condition #13: Signs do not stop access to lake during winter months. A fence or <br />something more secure should be installed. <br />Mr. Pepin stated that there are "parties" after hours of operation, and alleged that strong <br />beer was being consumed. Council member Barnes requested that Kellison and Pepin <br />state their complaints in writing for City records. <br />Miron made motion, Goiffon seconded, to table Mr. McElmury's request until the City's <br />CEO inspects the site for compliance with the issued SUP and the Washington County <br />Sheriffs Department report on late hours of operation and consumption of strong beer. <br />All aye. Motion Carried. <br />SPECIAL USE PERMIT - BARRETT <br />Dr. Bill Barrett has requested a special use permit, site plan approval, and variance to <br />construct a 2800 square foot addition, clock tower, and parking area on his site at 5673 <br />147th St. Roof drainage on the addition will be directed by scuppers on the east side of <br />the building to the north sewer basin. Stormwater drainage will be directed to the sewer <br />at the northeast corner of the property. MnDOT had no objection to the proposed <br />location of the clock tower as it does not obstruct the view from 147th St. The PC <br />
