The amended <br />ordinance reflects State Statute, and permits that daycare facilities in residential districts <br />may have up to 14 children, the limit imposed by law. <br />Leroux made motion, Agness seconded, to adopt ORDINANCE 1996-313, AN <br />ORDINANCE ESTABLISHING CHAPTER 75 OF THE CITY CODE, DESIGNATING <br />AND DEFINING ZONING DISTRICT FOR DAYCARE CENTERS WITHIN THE CITY <br />OF HUGO. <br />VOTING AYE: Agness, Barnes, Goiffon, Leroux, Miran <br />Motion Carried. <br />SUP RENEWAL BALD EAGLE SPORTSMAN ASSN.) <br />The Administrator stated that the City has not received any complaints relative to the Club's <br />operation. The Council then reviewed the existing Permit and conditions noting changes <br />when needed. <br />Leroux made motion, Goiffon seconded, to renew the SUP for the Bald Eagle Sportsman <br />Association for a two-year period, with the noted changes. <br />VOTING AYE: Barnes, Goiffon, Leroux, Miron <br />ABSTAINED: Tim Agness <br />Motion Carried. <br />ED WALLER (DRAINAGE) <br />The Council reviewed a letter written by Ed Waller regarding drainage under T.H. 61 near <br />Forest Boulevard, and the need for ditch/culvert cleaning. <br />Leroux made motion, Goiffbn seconded, that the City contact the RCWD regarding our <br />interest in having Hardwood Creek cleaned, and that the City will coordinate the cleaning <br />effort among the agencies involved (RCWD, MNDOT, and Washington County). <br />All aye. Motion Carried. <br />HEARING (ALLEGED LIQUOR LICENSE VIOLATION) <br />It is alleged that alcoholic beverages were served to a minor at Senor Ricci's of Hugo, Inc., <br />located at 14777 Forest Blvd., on March 2, 1996. When this matter was brought to the <br />City's attention, the Council authorized staff to negotiate a Stipulation Agreement with Mr. <br />Raymond Bogatty, owner of Ricci's. The City was not successful in these efforts, and <br />subsequently the City Council established this evening's meeting as a time to conduct a <br />hearing on the violation in accordance with Chapter 150 of the City Code. Washington <br />County Deputy Tim Tudhill, representing the City, and Mr. Raymond Bogatty, owner of <br />Ricci's, representing himself, testified before the Council with their version of the events of <br />
