City Council meeting of May 1. 1995 <br />Page 2 <br />County's bid documents as an additional item, which may be withdrawn after <br />a contractor is chosen. The City Engineer discussed his review of the <br />County's roadway plan and the proposed City utility project. It was Mr. <br />Dresel's recommendation that at the time of road construction, the City <br />lay a 12" utility line along 8A. This recommendation prompted questions <br />regarding on how the improvement would be paid for. In addition to <br />approval of the Agreement with Washington County, the Council should also <br />schedule a public hearing date under Chapter 429 in order to legally make <br />any assessments for the project. Council member Barnes requested that the <br />City review the City's engineering costs incurred for the project. <br />Leroux made motion, Goiffon seconded, to schedule a public hearing for <br />June 5, 1995, at 7:05 PM, Hugo City Hall, in accordance with Chapter 429, <br />to consider making an assessment for utilities and driveway aprons for the <br />C.F. 8A improvements. <br />All aye. Motion Carried. <br />Miron made motion, Leroux seconded, to adopt RESOLUTION 95-6 A RESOLUTION <br />APPROVING FLANS FOR COUNTY PROJECT NO. 94-85o3 SHOWING PROPOSED ALIGNMENT, <br />PROFILES, GRADES AND CROSS-SECTIONS. <br />VOTING AYE: Barnes, Goiffon, LaValle, Leroux. Miron <br />Motion Carried. <br />ROCK: CRUSHER ORDINANCE <br />At the request of Dean Atkinson, consideration of changes to the City's <br />rock crusher ordinance was tabled until this evening's meeting. Mr. <br />Atkinson was present with his attorney, Bruce Malkerson, to further <br />discuss the proposed ordinance change. It was suggested that the City <br />deal with Mr. Atkinson's situation with an Agreement that would cite the <br />historical status of his mining site, and create a freestanding ordinance <br />dealing with rock crushers. <br />Miron made motion. Leroux, seconded, directing City staff to work with Mr. <br />Atkinson and his attorney to draft an Agreement outlining the parameters <br />of Mr. Atkinson's operation based on historical data. <br />All aye. Motion Carried. <br />Leroux, made motion, Goiffon seconded, to postpone action on the proposed <br />ordinance until such Agreement is finalized. <br />All aye. Motion Carried. <br />DOG ORDINANCE <br />The Council received a revised animal control ordinance, which has been <br />amended based on Council discussion. <br />Leroux made motion, Goiffon seconded, to schedule a public hearing for the <br />ist meeting in July, to consider adoption of the proposed dog ordinance. <br />All aye. Motion Carried. <br />
