City Council meeting of July 17, 1995 <br />Page 2 <br />CERTIFICATE OF OCCUPANCY ORDINANCE <br />Miron made motion, Leroux seconded, to schedule a public hearing for <br />Monday, August 21, 1995, at 7:05 PM, to consider a proposed ordinance <br />adopting the Minnesota State Building Code as revised and providing for <br />its application, administration, and enforcement; and providing for the <br />repeal of all inconsistent ordinance. <br />All aye. Motion Carried. <br />The building inspector is to review the proposed ordinance and make any <br />comments regarding its content. <br />F_I VER.__C I TY ._ ASPHAL 1_ QPEC I AL USE _F_E RM I T.1 <br />Allan Barnard, representing FCA, and Jonathan Miesen, representing Hugo <br />2000, had no objection to the Special Use Permit, as proposed. <br />LaValle made motion, Leroux seconded, to approve the Special Use Permit <br />for River City Asphalt to conduct mining operations at the E 1/2 of the SE <br />1.!4 of Section 22, WIN, R21W, subject to 12 special conditions. <br />All aye. Motion Carried. <br />R:f.VE.R Q'l:TY ASPHALT (MININS PERMIT) <br />The Council reviewed the Mining Permit, and the proposed 16 conditions, <br />with discussion of conditions 6I) (trees), 9 (escrow deposit), and 14 <br />(defining operations), in particular. All parties came to an agreement <br />regarding 6D and 9, but the attorneys present disagreed on the definition <br />of "operations" as it related to the generator set.. RCA felt that the <br />generator should not by included in the definition of operations, and that <br />they should be allowed to warm up the generator one half hour prior to the <br />7:00 AM allowed start up time. Hugo 2000 felt that the generator was a <br />part of the definition, and should not be allowed to start until 7:00 AM. <br />LaValle made motion, Goiffon seconded, to approve the Mining Permit for <br />River City Asphalt to conduct mining operations at the E 1/2 of the SE 1/4 <br />of Section 22, T31N, R21W, subject to 16 conditions. Condition 6C should <br />be determine by the City Engineer regarding the number of pounds of seed <br />to be applied to the site. Condition 9 should indicate an amount of <br />$2,500 to be deposited to cover the cost. of City inspections. Condition <br />14 should remain the same allowing_ for a start up time of 6:30 AM for the <br />generator set. <br />VOTING AYE: Goiffon and LaValle <br />VOTING NAY: Leroux acid Miron <br />Motion Denied. <br />Leroux made motion, LaValle seconded, to change Condition 14 to allow for <br />a start up time of 6:45 AM for the generator set. <br />VOTING AYE: Goiffon, LaValle, Leroux <br />VOTING NAY: Miron <br />Motion Carried. <br />
