City Council meeting of September 5. 1995 <br />Page 2 <br />reviewed the ordinance, and had minor changes they wanted made to the <br />draft ordinance. <br />Leroux made motion, Goiffon seconded, to adopt ORDINANCE 95-305, AN <br />ORDINANCE REGULATING THE DEVELOPMENT OF SHORELANDS AND REPEALING <br />INCONSISTENT ORDINANCES. <br />VOTING AYE: Goiffon, LaValle, Leroux, Miron <br />VOTING NAY: Barnes <br />Motion Carried. <br />City Attorney Galler is to respond to Mr. Duffy notifying him of Council <br />action. <br />BROWN'S CREEK STORMWATER MANAGEMENT PLAN <br />The City Engineer is currently investigating the feasibility of <br />establishing managed outlets from the Plaisted/School Section/Goggins Lake <br />area, as well as the large pond currently flooding July Avenue. In <br />addition, he is reviewing the feasibility of the City taking emergency <br />measures to lower the water elevation of these water bodies. Pete <br />Willenbring of OSM reported his findings for Council review. After a long <br />discussion, it was determined that because of the number of governing <br />agencies involved, and permits needed to be obtained prior to any release <br />of water, there would be no "immediate" solution to the flooding problems. <br />Miron made motion, Goiffon seconded, directing the City Engineer to <br />prepare a fact sheet of information known in the flooding situation and <br />provide it to Grant Township, May Township, and the Brown's Creek WMO. <br />The City Administrator shall prepare a letter, for City Council approval, <br />for submission to Washington County, requesting the County's assistance to <br />find a solution to the flooding problems considering that the drainage <br />area crosses City and Township boundaries. <br />All aye. Motion Carried. <br />HOMESTEAD AVENUE POND OUTLOT FEASIBILITY REPORT <br />The City Attorney stated that he had heard from Jim Brevig's attorney <br />regarding this matter, and that he had asked that the Council deter any <br />action on this matter until he had addressed the Council. Pete <br />Willenbring from OSM has done all the research relative to this matter. <br />The Council discussed options available to relieve the drainage problem on <br />the Waller property, as well as how the project could be paid for through <br />assessments. <br />Leroux made motion, Goiffon seconded, directing the City Engineer to <br />provide a cost estimate to drain the area with a drain -tile system along <br />County Road BA, and contact Washington County for any comments they may <br />have on the proposed project. Greg Galler shall notify Mr. Brevig's <br />attorney of the action taken by the City Council. <br />All aye. Motion Carried. <br />
