City Council meeting of November 6. 1995 <br />Faae <br />conservation plan to the DNF by January 1, 1996. The City Engineer <br />estimated the cost of preparing such a plan to be $6,000. Councilman <br />LaValle was concerned that the City had not budgeted for such an <br />expenditure. <br />Leroux made motion. Miron seconded, authorizing the City Engineer to <br />proceed with preparation of the Water Conservation Flan, at a cost of <br />All aye. Motion Carried. <br />PETITION TO VACATE A PORTION OF 126TH STREET <br />At the Council meeting of October 16, 1995, the Council tabled action on a <br />petition made by Wilson Tool to vacate a portion of 126th Street running <br />across their property. This action was taken in order for the full <br />Council to consider the request. <br />Miron made motion. Goiffon seconded, to adopt RESOLUTION 95-16, A <br />RESOLUTION VACATING A ROADWAY EASEMENT AS PER PETITION OF WILSON TOOL <br />INTERNATIONAL. <br />Council members Barnes and LaValle restated their concerns with vacating_ <br />the easement, and the City Engineer reported on his efforts to obtain a <br />crossing at 134th Street. State Statute was cited where the City shall <br />notify the DNR, by certified mail, of the proposed request for vacation. <br />Because of Council concerns of vacating the easement at this time. Mr. Tom <br />Emery, representing Wilson Tool, stated that he would be willing to <br />withdraw the request. <br />Leroux: made motion to table the request to allow time for the City to <br />notice the DNR of the proposed petition for vacation. <br />Motion died for lack of second. <br />Miron made motion, Goiffon seconded, to table this request until the first <br />meeting in February, 1996, to allow staff to notify the DNR of the <br />petition, and allow for further negotiations with the Burlington Northern <br />Railroad and MNDOT for the 134th Street crossing. <br />All aye. Motion Carried. <br />MINING PERMIT (INDYKIEWICZ) <br />Mr. George Indykiewic" 1920 W. Highway 96, New Brighton, MN., requested <br />renewal of his permit to mine sand and black dirt from his property <br />located in the W 1/2 of the N 1/2 of Section 17, T.31N. R21W. <br />Miron made motion. Barnes seconded, authorizing renewal of the Mining <br />Permit for George Indykiewicz until November 1. 1996, under the terms and <br />conditions of the existing Mining Permit. <br />All aye. Motion Carried. <br />
