Planning Commission Meeting March 27, 2003- page 2 <br />single family detached homes within the permitted density range, while preserving trees along the <br />perimeter of the site and providing sanitary sewer service in the Shoreland Overlay District of <br />Bald Eagle Lake. The developer was also working with the City to oversize the storm water <br />management system to address the existing drainage issues east of the site. Lindahl explained that <br />the benefit of these public improvements was being proposed in exchange for flexibility in the lot <br />size requirements. <br />Chairman Schumann opened the public hearing. <br />A resident at 4753 126th St. Ct. N. said a survey stake had been placed in his yard and he was <br />concerned that the water from the development would end up on his property. He indicated that <br />the property slopes towards his back yard. <br />Jolene Servatius, 12770 Europa Ave. N., questioned the open ditch system and its maintenance. <br />Servatius was concerned that the ponds shown on the plat would not contain the water from the <br />development and would overflow. She asked for assurance that water problems in the area would <br />not increase due to this development. <br />Steve Bono from Heritage Development stated that they had conducted a neighborhood meeting <br />and received good feedback from those who attended. Bono said the builder they had selected, <br />Keesey Homes, was a very well known homebuilder and Bono showed examples of types of <br />homes to be built. He indicated they would be constructed of natural material and would all be <br />different in style and design. Bono stated that the common areas of the site would be maintained <br />by an association, the entry monument would be landscaped, and the trail would remain natural. <br />He said all significant trees were noted on the plan and would be left remaining. Bono stated that <br />the development site would be accountable for their own water, and the infiltration ponds would <br />flow into the lake during a 10 -year event. The developer would be working with the City to <br />oversize the storm water management system to address the existing drainage issues east of the <br />site. <br />Darren Meyer, the project manager for the development, explained where the drainage would go <br />for each individual lot. Meyer stated that there would be language in the development agreement <br />that would provide the City an easement to clean out the ponds and charge it back to the <br />homeowners association if necessary. <br />Dwight Harvey, 12471 Ethan Ave. N., had questions about the walking trail, how many slips were <br />permitted on the dock, and the elevation of the ponds. Bono replied that the trail would be a six- <br />foot wide asphalt trail that would not interfere with any trees. He explained that the County only <br />allowed six slips on the dock without a permit. Bono provide Harvey the elevations of the ponds. <br />Matt Koreen, 12490 Europa Ave. N., asked who would maintain the ponds since the homeowners <br />were not engineers and would not know how to maintain it on their own. Planner Lindahl <br />explained that provisions in the development and homeowners' agreements would provide for it. <br />Kim Simanski, 12340 Europa Ave. N., asked if they would consider constructing a berm between <br />her property and the pond.
