Planning Commission Meeting July 11, 2002 - page 3 <br />Rosemary Gorence, 6125 150`h St. N., presented the Planning Commission a petition signed by 29 <br />property owners that stated they disapproved of the proposed development. <br />Ken Gust, Engineer, said that when the infrastructure was put in for the Oneka Lake View <br />Townhomes, it was constructed to accommodate the subject property. <br />Residents of the Oneka Lake View Townhomes stated their displeasure with the builder of their <br />homes. <br />There were no other comments and Schumann closed the public hearing. <br />Rosenquist said the Commission should follow staff's recommendation to deny the application. <br />Peltier said she felt it was no place to build a home. <br />Malaski was concerned with traffic issues and whether the common drive would accommodate <br />fire and emergency vehicles. <br />Kleissler agreed that they should follow staff's recommendation. She said that, should Oneka <br />Lake Boulevard be widened, the homes would be too close to the road. <br />Schumann said there would be too much impervious surface, and development should be <br />consistent with the single family housing on the south side of Oneka Lake Boulevard. <br />Schumann made motion, Peltier seconded, to recommend denial of the conditional use permit and <br />preliminary plat for Oneka Lake View South. <br />All Ayes. Motion carried. <br />Lakeview Hugo LLP — Legacy Plat <br />The Commission held a public hearing to consider the application of Lakeview Hugo, LLP, 3500 <br />Willow Lake Boulevard, Vadnais Heights, to rezone to PUD, approval of a PUD general plan and <br />approval of a preliminary plat to be known as "Legacy" for property located east of Elmcrest <br />Avenue, west of Fenway Boulevard, north of 130`h Street and south of 1401h Street. <br />The development team consists of Len Pratt, John Peterson, and Derek Passe, who were in <br />attendance at the meeting to answer questions from the Commission. <br />Approval of the preliminary plat would allow the creation of 52 single-family detached home lots <br />and three outlots on the 102 -acre site. The development would provide two outlots proposed for a <br />City park and common open space, and an outlot for a future phase of development. The existing <br />home on the site would be incorporated into the first phase of construction. <br />The applicant requested approval of a rezoning from R -3/R-1 to PUD in order to provide smaller <br />lots east of Clearwater Creek. Staff found it would be consistent with the Comprehensive Plan <br />
