Minutes for the Planning Commission March 22, 2000 - Page 2 <br />Julie Jeffery -Schwartz, appraiser for Lakestate Realty, stated the property proposed to be removed from the <br />2020 Urban Development Area would greatly reduce the value of the property because it would no longer <br />be in the MUSA. She stated lake front parcels are a valuable tax base and would be a greater benefit to the <br />City should it be developed. Also of concern was the City's Right of First Refusal to purchase the Bernin <br />property since removing it from the service area would decrease its value, making it more attainable by the <br />City. Ms. Jeffrey -Schwartz warned of possible legal ramifications should value be taken away from the <br />property owners. <br />Puleo, 6375 165th St. N., stated he had participated in an extensive Southwest Oneka Lake Stomwater <br />Management Study with the understanding that Bernin and Riopel had no intention of developing the <br />property and cleaning out the ditch, which would remove a large portion of the property from the flood <br />plain. <br />Bev Aplikowski stated she had requested her property be brought into the MUSA and was asked to <br />participate in the ditch study which she did, feeling she would then be allowed to develop her property once <br />the ditch was cleaned. <br />Mike Riopel, 6421 165th St. N., stated he had no intention of developing now but wanted to continue to <br />farm his property without possible complaints from future homeowners should the neighboring property be <br />developed. <br />Council Member Barnes felt the Metropolitan Council may recognize the stomwater plan and ditch project <br />as being necessary for the orderly progression of land development, and may consider including all <br />properties in separate phases. <br />Schumann closed the public hearing. <br />Kellison made motion, Peltier seconded, to table consideration of the 2020 Urban Development Area <br />change to allow staff time to consider legal ramifications and speak to the Metropolitan Council. <br />All AYES. Motion carried. <br />Kellison made motion, McRoberts seconded, to recommend approval of amending the City's <br />Comprehensive Sanitary Sewer Plan to reflect the City's intent to use the Metropolitan Council <br />Environmental Services' trunk sewer main, which is to be constructed along Elmcrest Avenue and 145, St. <br />All AYES. Motion carried. <br />Zoning Code Amendment (Wagner Greenhouses) <br />The Planning Commission held a public hearing to consider the request of Wagner Greenhouses, 6024 Penn <br />Avenue South, for a Zoning Code Amendment to allow wholesale plant nurseries in the General Business <br />District. This would allow for the continued use and possible expansion of their business located at 4860 <br />Frenchman Road. Staff recommended that the amendment be denied, as it is not in conformance with the <br />City's Comprehensive Plan. <br />Puleo read the public notice and opened the meeting for comment but there was none. <br />Planning Commission Member Puleo stated he would participate in the disucssion but abstain from voting, <br />since he operated a similar business. <br />
