Minutes for the Planning Commission February 24, 1999 - Page 2 <br />Puleo read the public notice as published in the White Bear Press, and opened the meeting for public comment but there was <br />none. <br />Mr. Scanlan explained that the existing horse barn is quickly rotting due to extensive water damage and expressed concerns <br />about safely running his horse operation. Mr. Scanlan currently has 15 horses and is unable to keep all of them in the barn. <br />Mr. Scanlan said he would be approaching the Planning Commission again in the near future to discuss issues involving the <br />home he planned to construct such as driveway access and setbacks from the lake. <br />Malaski questioned whether a special use permit should be permitted prior to addressing these issues. Mr. Scanlan assured the <br />Planning Commission he would definitely be building the home, but the details would have to be worked out. <br />Kellison felt a letter of credit would be necessary to ensure the house would be built. <br />Kellison made motion, Peltier seconded, to recommend approval of the special use permit to construct a 44' x 70' accessory <br />building prior to construction of residence with the following conditions: <br />1. The property owner is to combine Government Outlot 1 and 2, Section 4, T3 1N, R2 IW into one parcel of record. <br />2. Construction of a residence on the property is to commence within 18 months of the issuance of this SUP. <br />3. The existing 40' x 120' barn on the property shall be demolished and removed within twelve (12) months of the completion <br />of the new barn. <br />4. The property owner is to provide the City with a letter of credit or cash deposit, in the amount of $10,000 to insure removal <br />of the existing building and construction of the residence, as specified. <br />5. Use of the accessory building shall comply fully with the City's zoning ordinance. <br />All Ayes. <br />Motion carried. <br />Site Plan Approval-Sotelo Body & Paint <br />Mr. Brian McGoldrick, 14715 Square Lake Trail, Stillwater, MN, and Mr. Bruce A. Sotelo of Sotelo Body & Paint, 1556 5th <br />St., White Bear Lake, MN, had requested site plan approval to use McGoldrick's building at 5100 130th St. N. (the old Dyna <br />Glass building), for auto body repair and painting. The property is located in the City's Industrial Zoning District, which allows <br />auto body repair shops as a permitted principal use. <br />Bruce Sotelo and his fiancee, Nancy, were present at the meeting and stated that according to Mr. McGoldrick, an asphalt <br />driveway was to be installed by September 1, 1999. They had also been working with the Fire Chief and Building Inspector <br />regarding building code requirements. <br />It was determined by the Planning Commission and staff that Mr. McGoldrick has not been in compliance with conditions of his <br />previous site plan. <br />Kellison made motion, Malaksi seconded, to table the site plan approval until the owner, Mr. McGoldrick, presented an <br />adequate plan on how he will accommodate two tenants in the building. <br />Ayes: Kellison, Kleissler, Malaski, Peltier, Puleo <br />Abstain: Schumann <br />Motion carried. <br />Kellison directed staff to contact Mr. McGoldrick and advise him to be at the next meeting. <br />Street Design Standards <br />The Rice Creek Watershed District had requested the City of Hugo consider reducing its required street widths for urban <br />residential development. <br />The Planning Commission agreed the street issue should be considered <br />
