Minutes for the Planning Commission May 26, 1999 - Page 2 <br />Another issue was the lift station, which Kelliher state would be accessible by roadway, and the property to the north and south <br />would be stubbed for future development. It was noted that the City Engineer had not had a chance to review the plan and provide <br />his comments on the lift station issue. <br />Kleissler asked their reasons for constructing a private drive verses a City street, and was told by Kelliher that the smaller road <br />would have less impervious service and would be maintained privately by a homeowners association. <br />Kellison felt there was inadequate parking, and the density of 7.6 units per acre was too high. <br />The City Administrator stated the utility and storm water plans had been submitted too late for the engineers to have adequate time <br />to review them. <br />Kellison made motion, Peltier seconded, to table the Planned Unit Development to be known as Eagle View Meadows until the next <br />Planning Commission meeting on June 23, 1999. <br />All Ayes. Motion carried. <br />SUP Renewal (Thommes & Thomas Land Clearing) <br />The Planning Commission held a public hearing to consider the request of Thommes and Thomas Land Clearing, located on 50.31 <br />acres of vacant land adjoining 5728 165th St., for renewal of their special use permit to continue using the property specified above <br />to process, store, and recycle tree waste. The property is generally located west of T.H. 61 and south of 165th St. <br />The Planning Commission had reviewed a letter from the MN Department of Natural Resources directing the City not to issue large <br />scale burning permits in the community. The letter stated that the public had become less tolerant of smelling and breathing smoke <br />from large scale or frequent burning of tree debris. <br />Dave Newberg, Attorney for Thommes & Thomas Land Clearing, was present and stated he had spoke to the DNR and was told the <br />rules and regulations regarding burning had not been finalized. He asked that the special use permit be approved with modification <br />to burn only as is allowed by the DNR. <br />Kellison asked if the inability to burn wood would cause problems to the business. Thomas stated it would, and one way to ensure <br />operation would be to bring in a tub grinder. He stated the tub grinder is very loud, and would be brought in as needed so the hours <br />of operation would vary to whatever is economically feasible. It was determined that Thomas and Thommes would need a special <br />use permit to run this grinder. <br />Puleo open the meeting for public comment, but there was none <br />It was stated the DNR had received complaints regarding large scale open burning, and the City had received a legal order not to <br />allow it due to concerns regarding the air quality in the Metropolitan area. It was also felt that large amount of tree waste could <br />create a hazard. <br />Kellison made motion to deny the renewal of the special use permit for Thommes and Thomas Land Clearing. Motion failed due to <br />the lack of a second. <br />Schumann made motion, Peterson seconded, to extend the special use permit for 90 days, allowing them time to derive a way to <br />dispose of wood, with a provision for no additional material accumulation on the site or unauthorized burning. <br />Ayes: Kleissler, Peterson, Schumann, Puleo <br />Nays: Kellison, Malaski, Peltier <br />Motion carried. <br />Special Use Permit Renewal (John Olsen) <br />The Planning Commission held a public hearing to consider the request of John Olsen, 14728 Irish Ave., for renewal of his special <br />use permit to use 20% of the 7.75 acres specified above to process and store wood. <br />The Planning Commission considered a memo from the Hugo Fire Chief stating the DNR's authorization to the issuance of a limited <br />scope burning permit to the Olsens for one more year. Also considered was a petition signed by neighbors supporting John Olsen's <br />operation. <br />
