The 43 acre open space north of 140th <br />St. is available for the homeowners association drainfield. <br />Excluding public water, the PUD has approximately 158 acres. This <br />translates to 11 acres of park dedication. The proposed park is 5.17 <br />acres. Outlot A is 2.17 acres. The acreage of outlot B, a potential <br />resolution to condemnation for 140th St., is another 1.44 acres. The <br />combination of these properties is 8.78 acres or 5.5% of the land area. <br />Ed Elliott advised the applicant that the application was considered <br />incomplete until engineering work had been submitted. <br />The Commission had reservations recommending approval of the subdivision <br />with the existing problems, such as lake and road flooding, Keystone Ave. <br />drainage, and alignment of the south cul-de-sac. <br />Motion made by Kellison, seconded by Peltier to recess the public hearing <br />until such time that the application is completed. <br />AYE: Schumann, Malaski, Rubenzer, Kellison, Peltier <br />NAY: Waller <br />Motion passed. <br />UBDIVISION - LARRY GERTEN <br />Larry Gerten is requesting to subdivide approximately 22.2 acres into 2 <br />lots. The property is located southwest of Horseshoe Lake with access <br />from Henna Avenue North. The land is zoned agricultural and guided rural <br />residential. The proposed lot sizes are 9.6 and 12.6 acres. The 12.6 <br />acre lot requires an 881variance to road frontage. These proposed lot <br />sizes are being requested due to the location of a drainage ditch running <br />north -south through the property, providing a natural separation of the <br />properties. <br />The existing driveway serves the Gerten residence, approximately 700 ft. <br />west of Henna Ave. The new lot will provide a house pad more oriented <br />toward the street. Strict enforcement of the ordinance would move the <br />12.4 acre parcel lot line north 88 feet, reducing the 9.6 acre parcel by <br />.6 acres. Little practical value would be gained by the change. <br />Mr. Gerten provided a letter from NSP stating that they would not object <br />to deeding the property back to the Gerten's and NSP would obtain an <br />easement over the property to maintain their equipment. <br />Motion made by Kellison, seconded by Peltier to recommend approval of the <br />request of Larry Gerten to subdivide 22.2 acres (Parcel 93004-0016) into <br />two lots subject to the following special conditions: <br />
