Minutes - November 20, 1996 <br />Page 4 <br />Commissioners concurred that a facelift, without excess costs, would be appropriate at this time. <br />The applicants agreed that some painting and minor repairs would be done. <br />Motion made by Kellison, seconded by Rubenzer to recommend approval of the SUP for an off sale liquor <br />store at 14583 Forest Blvd. be approved subject to issuance of an off sale liquor license. <br />AYE: Waller, Schumann, Rubenzer, Kellison <br />NAY: Peltier <br />Motion carried. <br />SITE PLAN AMENDMENT - KENCO CONSTRUCTION <br />Mr. Don Jensen, representing Kenco Construction, Incorporated stated that they <br />requesting to relocate a water quality pond currently located west of Geneva Ave., 350 <br />feet south of 144th Street, 250 feet east of Geneva Ave., to Outlot B, RiceLake <br />Meadows, 2nd Addition, 250 feet east of Geneva Ave., 300 feet south of 144th St. The <br />pond will act as a stormwater quality pond for a 1.01 acre drainage area in Rice Lake <br />Meadows 2nd and 3rd additions. A change in development plans for the property south <br />of the existing development makes it impossible to leave the pond where it is. <br />Area residents were concerned that the new location would not handle the stormwater as <br />effectively as the current location. Certain residents objected to the relocation because <br />they bought their property based on the fact that there was or wasn't a pond adjacent to <br />their property. With the approval of this request their properties would be directly <br />affected. Jim Merila stated that the new pond would have a more gradual slope and <br />would be somewhat smaller than the existing pond. He also indicated that the water <br />would flow from the paved street through a grass swale to the pond and that there is no <br />plan for a catch basin or underground piping to the pond. Mr. Merila stated that the <br />direction of the roadway would have to be changed to direct the water to the pond. Mr. <br />Jensen informed the Commission stated that if necessary Kenco would install a pipe to <br />the pond. <br />Motion made by Rubenzer, seconded by Kellison to recommend approval of the Amended <br />Special Use Permit for Kenco Construction, Inc., to relocate the pond currently on the <br />Wegleitner Property south west of Geneva Avenue and 144th St., to Outlot B, Rice Lake <br />Meadows, subject to the following conditions: <br />1. Approval of the City engineer. <br />2. Approval of Rice Creek Watershed District. <br />3. Installation of a pipe from the roadway to the new pond location. <br />All aye, motion passed. <br />REZONING REQUEST - WALLER <br />Alice Waller excused herself from the Planning Commission to represent her mother in this request. <br />Margaret Waller, 14310 Homestead Ave. North, is requesting to rezone her 160 acre farm <br />from Agriculture to Long Term Agriculture (LTA) in order to enroll the property in the <br />Ag Preserves Program. The City Council approved the new zoning classification <br />November 4, 1996, which takes effect November 13, 1996. No changes to the current <br />farming activity are proposed. <br />
