Minutes - July 27, 1994 <br />Page 2 <br />Motion made by Kellison, seconded by Rubenzer to recommend approval of the <br />request of William Schifsky to subdivide 2.1 acres to be combine with <br />property owned by Kevin and Garland Vacinek, legal description on file in <br />the city clerk's office. <br />All aye, motion passed <br />A public hearing was held to consider the application of William and <br />Kathleen Wenzel, 5623 142nd St., for a special use permit to construct an <br />accessory building of 640 sq. ft. where 260 sq. ft. is allowed in the SFU <br />district as well as, a variance to construct the building 5' from their <br />west property line. <br />Mr. Wenzel stated that his existing garage is very small and he needed the <br />proposed accessory building for storage and his woodworking hobby shop. <br />Mr. stated that the workshop is for personal use only. <br />Motion made by Rubenzer, seconded by Kellison to recommend approval of the <br />request of William Wenzel, 5623 142nd St. to construct a 640 sq. ft. <br />accessory storage building on his property, but recommend denial of the 5' <br />ft. variance to the side property line. <br />All aye, motion passed. <br />A public hearing was held to consider the request of Richard J. Granger <br />for a Special Use Permit to construct a fast food restaurant at the <br />southwest corner of 147th St. and Trunk Highway 61, west of the abandoned <br />railroad tracks. The property is zoned concentrated business. <br />Area residents opposed the construction, but realize the property is zoned <br />for commercial use. Lighting, noise in the parking lot, and hours of <br />operation were the biggest concerns. <br />Motion made by Schumann, seconded by Agness to recommend approval of the <br />request of Richard Granger to construct a fast food restaurant at 147th <br />and Highway 61 as indicated on the site plan dated July 27, 1994, subject <br />to the following special conditions. <br />1. A drainage plan be prepared by Mr. Granger and approved by the City <br />engineer and if necessary, the Rice Creek Watershed District. <br />2. All parking and driveways on the lot be paved. <br />3. A landscaping plan be developed and approved for the site. <br />4. All walkways on site be separated from parking and drive areas by a <br />concrete curb no less than 6" in height. <br />5. Buffering of the development from adjacent residential property <br />owners be approved as part of the landscaping plan and shall include <br />a 6' to 7' high fence between the development and adjacent <br />residences. <br />6. All lighting on site shall be directed inward and no light source <br />shall be directly visible from any public road or adjacent <br />residential property. <br />
