P.C. Minutes - august 26, 1992 <br />page 2 <br />Commissioner Mezzano felt the two smaller lots should meet the zoning size <br />requirement of 10 acres because there is land available. After a brief <br />discussion by the Planning Commission the following recommendation was <br />acted on. <br />Motion made by Peltier, seconded by Agness to recommend approval of the <br />request of Keith Peterson to subdivide 39.8 acres into two lots of 9.95 <br />acres and one 20 acre lot, property described as follows: The northeast <br />1/4 of the southwest 1/4 of Section 28, T31N, R21W. Subject to approval <br />by Rice Creek Watershed District and the Department of Natural Resources. <br />All aye, motion passed. <br />SUBDIVISION Q. -Q <br />Rose of Sharon Manor, Inc. has submitted an application to subdivide two <br />existing parcels into four parcels. Parcel B of the surveyor's <br />certificate for the subdivision is exempted from the City's subdivision <br />regulations per Minnesota Statutes 462.358, subdivision 4.b. All of the <br />proposed parcels created by the subdivision exceed the ten acres required <br />in an agriculturally zoned district by the City's zoning ordinance. <br />Parcel E, requires a variance to the zoning ordinance, due to the fact <br />that it is 6.5 feet short in lot frontage width. All four parcels have <br />been tested and found suitable for on site septic systems by the <br />Washington County Public Health Department. This subdivision has been <br />reviewed by the Rice Creek Watershed District and the DNR who have no <br />objections to the subdivision as proposed. <br />Mr. Fred Fisher, attorney for Rose of Sharon Manor, Inc. was present to <br />answer any questions from the Commission. <br />Motion made by Olson, seconded by Mezzano to recommend approval of the <br />request of Rose of Sharon Manor, Inc for a minor subdivision, variance to <br />lot width frontage and waiver of the formal platting requirements to <br />subdivide 79 acres from two parcels into four parcels. Legally described <br />as follows: <br />Parcel A: That part of the southeast 1/4 of the northeast 1/4 of Section <br />28, T31N, R21W, Washington County, Minnesota lying west of the east 43 <br />rods (709.50 feet) thereof, and <br />Parcel D: The east 43 rods (709.50 ft) of the east 1/4 of the southeast <br />1/4 of Section 28, T31, R21, Washington County, Minnesota lying north of <br />the centerline of the Stillwater and Centerville Rd, now known as 132nd <br />Street No., except that part thereof described as follows: Commencing at <br />a point on said centerline distant 400.00 feet west of the east line of <br />said southeast 1/4, as measured along said centerline; thence northerly <br />and parallel with said east line 450.00 feet; thence westerly parallel <br />with said centerline 485.00 feet; thence southerly parallel with said east <br />line 450 feet, more or less, to said centerline; thence easterly along <br />said centerline to the point of beginning, and <br />
