Mr. Downs states that he
owns lots 5 and 6 and that the principal residence is located on both of
these lots, Mr. Downs' site plan shows the proposed garage located on
lot six, 30' from the road and 2' from the east property line. City
records indicate that the lots in question are 50' in width not 60' as
shown on the site plan. This change in dimension obviously effects the
setbacks from the road and property lines. Mr. Downs also shows the
existing home located on the property line between Lots 5 and 6 with the
rear of his house 18' from the east property line of Lot 5. If these
dimensions are correct Lot 5 should be only 46' in width as opposed to
the 60' shown by Mr. Downs. Mr. Downs has indicated that the proposed
garage would be used for residential purposes to store his motor
vehicles and other miscellaneous items. This request also involves a
variance allowing the construction of this garage within 2' of the east
property line assuming Mr. Downs 60' lot width is correct and city
records are incorrect. Under the circumstances it is virtually
impossible to make a recommendation in light of the conflict in site
dimensions. We would recommend that this matter be tabled until
