Planning Commission Minutes <br />April 11, 1984 Pg. 2 <br />water and sanitary seer✓er services, it shall not be <br />less than 160 ft. in width and contain less than 1 acre <br />unless otherwise provided in the zoning ordinance (290- <br />6 Subd. N Par. 7). <br />6. A plan or statement shall be submitted for over coming <br />soil limitation. <br />AYE: Schoeller, Atkinson, Potts, Rudisill, Olson, Lorch <br />NAY: Fashingbauer. Motion Carried. <br />`.►hite Bear Rod and Gun Club — Bruce P"alkerson, attorney for the <br />club stated they would favor leaving the special use permit as <br />is until further reports were submitted. Mr. Charles Johnson <br />stated it is legal to require changes however the court injunction <br />is still in effect. The commission would like the following comments <br />entered into the record; <br />A. Condition #9 of the SUP should be updated to reflect the <br />latest sta•us of local, state, and or Federal Noise statutes. <br />B. Condition #21 of the SUP should be amended to clarify that <br />a variance may be granted after consideration through due <br />process as specified in condition #16. <br />C. A condition should be added to make a lead shot recovery plan <br />as approved by the PCA and other concerned agencies, part of the <br />SUP as though set forth in full (similar to condition #3). This <br />condition shall also specify that the lead shot will be recovered <br />as often as the PCA dictates but no less than once annually in <br />September before the first frost. Failure to do so shall be <br />cause for revocation of the SUP. Said program shall also be <br />demonstrated to be in conformance with City Zoning Code 320-4, <br />Subd. D. pg. 21. " The proposed special use will substantially <br />further the purpose of managing and conserving areas that are <br />unsuitable for development or have special problems of develop— <br />ment due to wet soils or have a unique watershed or natural <br />ponding characteristics". <br />D. A condition should be added to make wildlife protection plan, <br />as approved by the Dept. of Natural Resources and other con— <br />cerned agencies part of SUP as though set forth in full (sim— <br />ilar to condition #3). <br />E. A condition should be added for a letter of Credit in a suit— <br />able amount to be furnished to the City of Hugo for lead shot <br />cleanup to prevent pollution in the event the club shuts down. <br />F. A condition should be added out lining state—of—the—art, un— <br />biased testing procedures to insure continued compliance with <br />noise standards and to specify the gun clubs financial obligations <br />for such testing. <br />Motion made by Potts, second by Atkinson to take no further action <br />on the Special Use Permit at this time. All aye, motion carried. <br />
