Hugo Planning Commission <br />December 28 1977 <br />Page 2 of <br />Page 2 (1st line in the amendment to the motion) - spelling of completion. <br />(7th line in the amendment to the motion) - be maintained by owner, <br />RICHARD & LARRY SCEDIIDT - SPECIAL USE PMnT <br />Mr. McAllister asked what the maximum capacity of the building was. Six hundred <br />was the declared maximum - 250 first room (bar & lounge). The second room will <br />be opened later. <br />Mr. Nielsen stated that they would like to gravel the parking lot in the back <br />rather than blacktop and they would like a variance to blacktop for one year. <br />Mr. Schmidt quoted the State Fire Marshall saying there was a capacity of 272 <br />people for the game room and bar & lounge. The bar room will not be opened on <br />week nights unless on special occasions. Angle of the lights shine 50' wide <br />and 40' deep. Mr. Schmidt stated that trees are $40.00 for a 2 foot tree. They <br />request that they be allowed to plant trees 2' or less. <br />Mr. McAllister asked if they would go along with the Police Department's recommen- <br />dations. Mr. Peloquin said that he didn't think it was anyones business whether <br />they have policemen or not. No other establishment in the city is required to <br />have policemen. <br />The Planning Commission took note of the Police Department's recommendations and <br />will forward it to the City Council. <br />McAllister made motion, seconded by Greger, to approve the Special Use Permit <br />for Richard and Larry Schmidt with the following restrictions: <br />1. Curb or fencing shall be required to be installed in such a manner to„de <br />access or egress to the back area other than the designated entrance including <br />the unpaved areas. <br />ti <br />2. That the declared maximum capacity is 600 people. <br />3. By September 309 1978, the owners blacktop sufficient space for 150 automobiles <br />total, minimum to be determined by existing ordinance. By September 30, 1979, <br />the ownersshall provide sufficient blacktop for 175 automobiles total. By <br />September 309 1980, the owners shall provide sufficient blacktop for 200 auto- <br />mobiles total, the declared maximum capacity. The owners shall provide a <br />irrevocable letter of credit to the city of Hugo in the first year in the <br />amount of $159000. The letter to be reduced by 1/3 of the face amount each <br />year* <br />4. Septic system be reviewed by the Buidling Inspector semi-annually and sent to <br />the Health Department, <br />5. That the screen by provided in the site plan and the trees be 2 - 3 feet and that <br />they be maintained and replaced if necessary. $19000 irrevocable letter of <br />credit be provided to the city until screening is completed. Screening to be <br />completed no later than September 309 1978. <br />
