Hugo Planning Commission <br />July 27, 1977 <br />Page 4of5 <br />Motion made by Peloquin, seconded by Gillen, to consider the Joe <br />Massa matter prior to Fred Fulbright. <br />All aye. Motion carried. <br />Joe Massa — Subdivision <br />Mr. Massa was unable to provide a legal description for his property <br />because, as yet, he has not had it surveyed. Ehret stated that Mr. <br />Johnson, City Attorney, felt that because the property of Mr. Massa <br />was not connected to any other property owned by him, that the re— <br />quest be allowed, provided a legal description is provided by Mr. <br />Massa. Mr. Massa said that Mr. Johnson advised him to go before <br />the Planning Commission to get their OK before he got the land surveyed. <br />Schwab stated that if Mr. Massa provided a certificate of survey, <br />the Commission could recommend approval. <br />Motion made by Peloquin to recommend approval of the site plan for <br />Joe Massa subject to a proper and adequate legal description sub— <br />mitted with application for the City Council's consideration, and <br />that the City Council set the fee involved for said request. Proof <br />of buildable lot to be provided by Mr. Massa. <br />Motion died for lack of second. <br />Peloquin made motion, seconded by Gillen, to recommend approval of <br />transfer of ownership provided a certificate of survey is submitted, <br />and fee to be set by City Council. <br />McAllister felt the request was not ready to be passed to the City <br />Council until a certificate of survey is, in fact, on file at City <br />Hall. <br />Peloquin withdrew his motion. <br />Ehret suggested that Mr. Massa provide the city with a copy of his <br />perc test, and when he has a certificate of survey, place his name <br />of the agenda. <br />Fred Fulbright — Rezonin <br />The Fulbright rezoning request was sent back to the Planning Commission <br />so that a legal description of the property to be rezoned could be <br />obtained. Copies of deeds were providedby Bruce Charpentier, but <br />they did not indicate a clear legal description of Mr. Fulbright's <br />property. Mr. Fulbright has stated that he would like his entire <br />piece of property rezoned from RB to SFE. <br />Motion made by Peltier, seconded by Peloquin, to table the Fred <br />Fulbright rezoning request from RB to SFE pending accurate legal <br />description for the property to be rezoned. <br />All aye. Motion carried. <br />
