Motion Carried. <br />MINOR SUBDIVISION (SCANLAN) <br />by Washington County Public Health be <br />by the RCWD. <br />Mr. Wayne Scanlan has requested a minor subdivision of his property at <br />17530 Henna Avenue, to allow creation of two 10 acre parcels from an <br />existing 20 acre parcel. In addition, Mr. Scanlan is requesting a Special <br />Use Permit to access Henna Avenue via a temporary, private driveway <br />easement. The Planning Commission recommended approval of the subdivision <br />and SUP subject to special conditions. <br />Miron made motion, Brunotte seconded, to approve the minor subdivision for <br />Wayne Scanlan to subdivide a 20 acre parcel into two 10 acre parcels, <br />subject to the following conditions: <br />1. The driveway easement be vacated when Mr. Scanlan's property is <br />further subdivided. This is to include adjacent property Mr. Scanlan <br />owns via separate property description. <br />2. Mr. Scanlan provide proof of ownership. <br />_. Approval of the subdivision by the RCWD. <br />4. Approval of the septic locations on each parcel by Washington County <br />Department of Public Health. <br />5. Submission of adequate Certificate of purvey. <br />6. Mr. Scanlan to attach Parcel A to his property to the west and north, <br />which would allow frontage on 177th Street. and not landlock Parcel A. <br />All aye. Motion Carried. <br />Leroux made motion, Stolt man seconded, to approve the Special Use Permit <br />for Wayne Scanlan allowinq access to Henna Avenue via a temporary, private <br />driveway easement. <br />All aye. Motion Carried. <br />REZONING _REOUE:S`f.._.._J_P - <br />Mr. Burdette Berntson of 1 '.686 Ethan R•;-enk...te has requested a rezoning of <br />approximately 28 acres located at Forest. Blvd., from AG to RR2 and <br />Retail Business. Mr, Berntson intends to SUt7divide the property into two, <br />five acre parcels for res.idei-it.ial use, and one 17 acre REQ parcel. The <br />Planning Commission considered Mr. Bernt.son`s request on February 23, <br />1994, and recommended denial of the reque.-•.t. of Mr. Berntson due to the <br />residential character of adiacent property. <br />Barnes made motion, Miron seconded, to deny the rezoning request of <br />Burdette Berntson to rezone 28 acres from AG to RR2 and RB. The City <br />Attorney is directed to prepare the necessary Findings of Fact for denial <br />of this request. <br />All aye. Motion Carried. <br />
