That minor body and paint work be allowed subject to all state and federal regu- <br />lations or codes for work on vehicles owned by the business only. <br />5. Refer 320-5-M-3: Refers to said regulations for inoperable cars. That the back <br />area of the property be maintained in a neat and orderly fashion. <br />6. The Special Use Permit is subject to annual review. <br />7. No more than thirty (30) cars parked on the property outside the building. There <br />shall be no cars allowed for storage on the eastern 50' of the property. <br />8. Trees or similar vegetation be planted along the northern 2 of the eastern property <br />line. Trees shall be planted 6' apart, rows 8' side, and alternate trees in each <br />row. <br />9. If Mr. Moe accepts the conditions of this permit, he allow the City Council to <br />count the number of cars inside and outside at any time. <br />VOTING FOR: Peloquin, Houle, Hanson, Greger and Peltier <br />VOTING AGAINST: McAllister <br />MOTION CARRIED <br />DAROU TAVmRNIFR - SITE PLAN (26 x 40 garage) <br />Mr. Tavernier presented his revised site plan. He restated that he has never been out <br />of business since the fire in April, 1977, and no new boats have been purchased. Mr. <br />Tavernier maintains an inventory of 10 boats. McAllister stated that the only option <br />the Commission has is to recommend to the City Council that they concur with the business. <br />Greger referenced 320-3, Subd. B. paragraph 101 and 320-59 Subd. 4 as reasons for con- <br />trolling the operation with a Special Use Permit. McAllister stated that a Special <br />Use Permit cannot be issued in the SFE zone for a boat rental business. <br />Motion made by McAllister, seconded by Peloquin, to recommend approval of the Site <br />Plan as submitted. The facts brought forth indicate that the business has never ceased <br />since the time of the fire and we recognize the business as a lawful non -conforming <br />use. Let the record show that the motion.was based on the feeling that this will not <br />intensify a lawful non -conforming use. <br />VOTING FOR: Peloquin, Houle, McAllister and Peltier <br />ABSTAINED: Hanson (no direct opposition to boat facility) <br />VOTING AGAINST: Greger <br />MOTION CARRIED <br />DAN SPITZER - SITE PLAN APPROVAL <br />Mr. Spitzer would like authorization to construct a 40 x 40 pole barn as indicated <br />in Site Plan as submitted. The land is zoned Agriculture. <br />
