City Council meeting of July 6, 1993 <br />Page 3 <br />Mr' Ken Roesler of Kenco Construction requested that the watershed <br />condition be removed from the motion' The motion stood as approved' <br />The Council received a letter from Merila and Associates, representing <br />Kenco, requesting reimbursement for certain public improvements <br />constructed during the 1st phase of the RICE LAKE MEADOWS subdivision. <br />The request may be broken down into two parts: <br />1. Reimbursement for oversized sanitary sewer and watermains, through the <br />project to eventually serve adjacent properties' <br />2' A request to assess adjacent properties in the future for installing <br />trunk facilities from Oneka Lake Boulevard to the project site. <br />Paragraph 20 in the Development Agreement between Kenco and the City of <br />Hugo, dated July 69 1992, states that the developer agrees to pay for all <br />costs incurred of whatever kind or nature in order to construct the <br />improvements indicated in this Agreement, or otherwise develop the <br />property' Based on this Agreement, it would seem to be inappropriate fpr <br />the City to assess adjacent property owners in the future for the trunk <br />facilities extended into the RICE LAKE MEADOWS subdivision by Kenco, given <br />that the subdivision could not be developed without them' Staff supported <br />reimbursement to Kenco for the oversized utilities to serve adjacent <br />properties, as this was specifically requested by the City to serve other <br />properties. <br />Miron made motion, Barnes seconded, that the <br />Construction for oversized utilities to serve <br />City develop a policy or ordinance to present <br />oversizing costs. <br />All aye. Motion Carried. <br />City reimburse Kenco <br />adjacent properties, and the <br />to the Council to recover <br />The Hugo Planning Commission conducted a public hearing on June 23, 1993, <br />to consider the granting of a SUP to Howard Arcand, et al, for the <br />construction of a golf course at the E 1/2 of the SW 1/4 and the W 1/2 of <br />the SW 1/49 Section 32, T31N, R21W, Washington County, MN. The PC <br />recommended approval of the SUP with conditions. <br />Stoltzman made motion, Brunotte seconded, to approve the Special Use <br />Permit for Howard Arcand, et alr for the construction of a golf course' <br />Approval is subject to certain conditions on record at City Hai l' <br />All aye. Motion Carried' <br />a1TE PLAN APPROVAL (ARCAND GOLF COURSE)_ <br />Howard Arcand, et al, has requested site plan approval for construction of <br />the golf course under the special use permit approved previously' The <br />plan has received approval from the Rice Creek Watershed District' DNR <br />
