Cit/ Council meeting of September 20, 1993 <br />Page 4 <br />Barnes made motion, Leroux seconded, directing the Cit/ Administrator <br />report to the Council status of brush cutting in the Cit/ of Hugo. <br />All aye. Motion Carried. <br />ENGINEER'S REPORT (DRAINAGE 8A AND 61) <br />At the Council meeting of September 7, 1993, a resident indicated a <br />concern for water ponding in the south east quadrant of County Road BA and <br />Highway 61. The City Engineer submitted a report indicating his <br />findings. If the Council feels this is an item of concern, it may be <br />addressed during the reconstruction of County Road BA during 1994. <br />Leroux: made motion, Stoltzman seconded, to accept the Engineer's report on <br />drainage in the south east quadrant of C.R. BA and Highway 61. <br />All aye. Motion Carried. <br />ENGINEER'S REPORT (WALLER DRAINAGE) <br />The Council received a report from the City Engineer regarding the alleged <br />drainage problems on the Waller property being caused by the Evergreen <br />Hills subdivision. The City Engineer's findings indicates that the <br />development has increased the water runoff across the Waller property to <br />some extent. The City Attorney stated that it is likely that the City has <br />no legal liability in this matter. In addition, any controls the Cit/ may <br />install to reduce the amount of flow across the Waller's property would be <br />expensive, and given the limited increase of water runoff, would have very <br />minor effects on the Waller's property. For these reasons, the staff <br />recommended that the Waller's request to have the City divert runoff from <br />Evergreen Hills property be denied. There was another lengthy discussion <br />regarding the history of drainage in the Evergreen Hills/Waller vicinity. <br />Stoltzman made motion to obtain a cost estimate for berming and extraction <br />of dirt north east of the existing holding pond. <br />Motion died for lace; of a second. <br />Barnes made motion, Miron seconded, authorizing the City Administrator to <br />contract with TKDA to loot: at evidence and offer options/solutions to the <br />Council. <br />VOTING AYE: Barnes and Brunotte <br />VOTING NAY: Leroux, Miron, Stoltzman <br />Motion Failed. <br />Leroux; made motion, Miron seconded, directing the City Administrator to <br />review the historical data gathered by the Waller family, review the USGS <br />maps to determine if there was easterly drainage prior to development, and <br />determine if the City has easements to make the project practical. <br />VOTING AYE: Leroux, Miron, Stoltzman <br />VOTING NAY: Barnes and Brunotte <br />Motion Carried. <br />
