City Council Minutes - March 2, 1992 <br />Page _ <br />VARIANCE REQUEST (TIPPELT) <br />Mr. Paul Tippelt, 15936 Harrow Avenue, has made application to the City of <br />Hugo for a variance to construct a 2,884 sq. ft. addition to an existing <br />garage. The total accessory storage meets the 3644 sq. ft. allowed in an <br />agricultural zone. If the previous site plan for the existing garage was <br />drawn to scale, it indicates that the existing garage should have been <br />located approximately 31 ft. from the south property line, while in fact, <br />the building was constructed 3.5 ft. from the property line. The site in <br />question is approximately 2.25 acres in size, and is on the east shoreline <br />of Onek:a Lake. There does not appear to be any hardship to the land, <br />which would necessitate a variance. The staff would recommend that the <br />applicant comply with the current setback:. regulations for the agricultural <br />zone. This matter was to be dealt with by the Board of Zoning Adjustments <br />on February 26, 1992, but due to the fact that Board Member Jesinsk:i was <br />the only member present, there was no discussion conducted on this <br />matter. The application is forwarded to the City Council without a <br />recommendation. <br />Motion made by Miron, seconded by Stolt man to approve the variance <br />request of Paul Tippelt, 15936 Harrow Ave., to construct a 2,880 sq. foot <br />addition to an existing garage, 3.5 feet from the south property line. <br />Voting AYE: Barnes, Brunotte, Miron, Stolt man <br />Voting NAY: Jesinsk;i <br />It was noted that Mr. Tippelt would li.k::e to change the dimensions of his <br />proposed structure from 40' X 72' to 36' X E30' with a lower roof. <br />Administrator Huber stated that the variance is only for the setback:: from <br />the lot line and not building size. <br />PRELIMINARY PLAT AMENDMENTS (COUNTRY FONDS) <br />On behalf of Arlington Properties (Country Ponds), Mr. Richard Sagstetter <br />has requested an opportunity to appear before the City Council to discuss <br />drainage concerns regarding the proposed Country Ponds subdivision. The <br />preliminary plat of the proposed subdivision was reviewed by the Planning <br />Commission, and subsequently approved by the City Council, subject to <br />special conditions. Although it is not clear in Mr. Sagstetter's letter, <br />it would appear that he is requesting that the City Council deviate from <br />conditions of preliminary plat approval Nos. 23 and 24. In the past, the <br />Planning Commission has requested that in cases where the developer wishes <br />to deviate significantly from the original preliminary plat proposal, the <br />request then be referred back: to the Planning Commission for review. In <br />light of the fact that the request in question would typically be dealt <br />with at the time of final plat review, we would recommend the City Council <br />follow current policy and deal with this issue at that time. If the City <br />Council wishes to address this issue prior to final plat review, we would <br />suggest that this matter be referred bact:: to the Planning Commission for <br />their review and input. <br />Mayor Stolt man stated that he did not approve of the "piece mealing" <br />effect and requests that the applicants appear before the City Council <br />when they have secured all required documents. Mr. Stolt man also stated <br />Fie would like to retain conditions 23 and 24 of the preliminary plat <br />approval. <br />
