Motion Carried. <br />SCHUMANN LETTER <br />This matter is in litigation, and a legal opinion has been requested as to <br />how to handle the permit since the City is in litigation with Mr. Schumann <br />over the use of the building. <br />EXECUTIVE SESSION <br />Miron made motion, Brunotte seconded, to schedule an executive session of <br />the Hugo City Council for Thursday, May 21, 1992, at 7:00 PM, to discuss <br />with the City's attorney, Mr. Jeff Carson, the ongoing litigation with Mr. <br />Schumann. <br />All aye. Motion Carried. <br />9.2 KRUEGER LETTER <br />Stanford and Sandra Krueger have submitted a complaint on the operation of <br />a ZAP game site located in Section 33, south of 132nd Street. The <br />Krueger's maintain that the facility is in violation of its Special Use <br />Permit due to the lack:: of proof -of -liability insurance, absence of <br />signing, lack of building permits, and generally is a detriment to the <br />community. Although just receiving a copy of Krueger's letter at <br />tonight's meeting, Anthony Caron, representing ZAP Games, attempted to <br />address the listed allegations. <br />LeroUX made motion, Barnes seconded, to refer this matter to the Planning <br />Commission to hold a public hearing to consider the allegations made by <br />Stanford and Sandra Krueger that ZAP Games is in violation of their <br />Special Use Permit. <br />All Aye. Motion Carried. <br />REQUEST TO RESERVE CITY PARK <br />Miron made motion, Stoltzman seconded, to approve the request of Melanie <br />LaCasse to reserve the City's park pavilion on Sunday, May 24, 1992, <br />subject to specified conditions. <br />All aye. Motion Carried. <br />PLANNING COMMISSION VACANCY <br />On May 13, 1992, Debra Barnes, Theodora Peltier, and Robert MusEUS <br />interviewed candidates for the vacant Planning Commission position. <br />Stoltzman made motion, Miron seconded, to accept the recommendation of <br />COUnci.lmember Barnes, and appoint Mr. Tin) Agness to the Hugo Planning <br />Commission, to fill the unexpired term of Chuck: Henry to expire 12/71/93. <br />All aye. Motion Carried. <br />
