City Council meeting of June 1, 199' <br />Pages _ <br />housing, which is allowable under the current zoning classification of the <br />parcel. The Planning Commission Field a public hearing on the preliminary <br />plat on May 27, 1992 and recommended approval of the plat as presented. <br />Administrator Museus stated that he had contacted Washington County <br />regarding the driveways from the new lots, and they stated that they had <br />no problem with the subdivision. The subdivision would place the existing <br />house on Lot 2, and the existing metal shed on Lot 1. Councilman Miron <br />stated that the subdivision would create a violation of the City's zoning <br />ordinance by allowing an accessory building, with no principal building, <br />without a Special Use Permit. The City could request a financial <br />guarantee for a specific length of time to assure a building permit is <br />obtained for Lot 1, or not allow sale of Lot 2 until a building permit is <br />obtained for Lot 1. There was also discussion of drainage on Lot 4 as it <br />affects the property owner to the east. <br />Barnes made motion, Miron seconded, to approve the preliminary plat for <br />subdivision of 5.6 acres into four lots, and waiver of the formal platting <br />process, as requested by fon and Pauline Daubenspeck of 5687 140th <br />Street. Approval is subject to the following special conditions: <br />1. Final grade on Lot 4 must divert drainage to the south, and avoid <br />runoff onto the adjacent property to the east. <br />2. Lot 2 may not be sold until a building permit is issued for Lot 1. <br />This is to avoid a violation of the City's zoning ordinance, which <br />prohibits construction of an accessory building prior to construction <br />of the principal building on any lot. <br />3. Payment of the park land dedication, in the amount of $525.00, must <br />be made upon filing of the final plat. <br />All aye. Motion Carried. <br />SPEC I FAIL. DIST.) <br />The Stillwater Public School District has requested a Special Use Permit <br />to replace an existing 24' X 40' moveable classroom with a 28' X 72' <br />moveable classroom on the site of the Withrow Elementary School. The <br />Planning Commission considered the request on May 27, 1992 and recommended <br />approval of the SUP. <br />Barnes made motion, Stolt man seconded, to <br />request of the Stillwater School District <br />40' moveable classroom with a 28' x 72' <br />Withrow Elementary School. <br />All aye. Motion Carried. <br />VARIANCETO SETBAC K_.(SHERMAN ).. <br />approve the Special Use Permit <br />#834 to replace an existing 24' <br />moveable classroom at. the <br />On May 27, 1992, the Board of Zoning Adjustments considered the reque,:t. of <br />William Sherman for a variance to the City's Shore.land Ordinance in order, <br />to construct a swimming pool on his property without the required 200' <br />shoreline setback:. The Board recommended approval of the variance. <br />Lerc:um made motion, Miron seconded, to approve the variance request of <br />William Sherman of 9130 125th Street to construct a swimming pool 155' <br />from Long Lake (200' required) . <br />All aye. Motion Carried. <br />
