City Council Minutes - July 20. 1992 F'aae 2 FINAL SUBDIVISION ACCEPTANCE (BIRCH TREE FONDS 3RD ADDITION)_ Administrator Museus stated that the City has a received a recommendation from the City engineer to accept Birch Tree Fonds 3rd Addition. According to the Cit; Engineer, all public utilities and streets serving this subdivision, have been constructed to City standards. The acceptance of these improvements, by the City Council is necessary for the City to assume responsibility for these improvements, and to allow issuance of building permits and certificates of occupancy. Administrator Museus stated that the infrastructure of the development is complete, except for planting of trees which will be done after construction of the residences. If the planting is not completed, a portion of the administrative deposit would be deducted in order for the City to complete the project. Motion made by Barnes, seconded by Miron -to accept Birch Tree Ponds Third Addition streets and utilities. All aye, motion passed. AGREEMENT WITH GRACE DEVELOPMENT FOR SOIL BORINGS In order to proceed with the acquisition of a si.te for the construction < the City's new water tower, the City Attorney has provided a Soil Boring Agreement for approval by the City, which would allow the City to conduct site -testing at possible locations for the tower. Sites for the testinq are all owned by Grace Development Corp., and are in the vicinity of the Bald Eagle Industrial Park. Attorney Charles Johnson stated that Grace Development Corp. has now regained ownership of the three properties in question. The contract for deed has been defaulted by Harstad Companies. Mr. Johnson has reviewed the content of the agreement with Howard M::i.uEi.sto. Mr. Johnson was unsure at this point if Judd Jackson has signed the agreement. GAS) to approve the Soil Borings to allow the City to conduct Northern Natural Gas has applied for a Special Use Permit to expand their existing regulator and meter facility located at the north e�.st corner of State Highway 61 and 175th Street in the City of HUOO. Northern Natural Gas has stated that the increased regulator size is necessary to serve tl increasing natural gas demands of the Community.
