City Council Minutes - July 20. 1992 <br />F'aae 2 <br />FINAL SUBDIVISION ACCEPTANCE (BIRCH TREE FONDS 3RD ADDITION)_ <br />Administrator Museus stated that the City has a received a recommendation <br />from the City engineer to accept Birch Tree Fonds 3rd Addition. According <br />to the Cit; Engineer, all public utilities and streets serving this <br />subdivision, have been constructed to City standards. The acceptance of <br />these improvements, by the City Council is necessary for the City to <br />assume responsibility for these improvements, and to allow issuance of <br />building permits and certificates of occupancy. <br />Administrator Museus stated that the infrastructure of the development is <br />complete, except for planting of trees which will be done after <br />construction of the residences. If the planting is not completed, a <br />portion of the administrative deposit would be deducted in order for the <br />City to complete the project. <br />Motion made by Barnes, seconded by Miron -to accept Birch Tree Ponds Third <br />Addition streets and utilities. <br />All aye, motion passed. <br />AGREEMENT WITH GRACE DEVELOPMENT FOR SOIL BORINGS <br />In order to proceed with the acquisition of a si.te for the construction < <br />the City's new water tower, the City Attorney has provided a Soil Boring <br />Agreement for approval by the City, which would allow the City to conduct <br />site -testing at possible locations for the tower. Sites for the testinq <br />are all owned by Grace Development Corp., and are in the vicinity of the <br />Bald Eagle Industrial Park. <br />Attorney Charles Johnson stated that Grace Development Corp. has now <br />regained ownership of the three properties in question. The contract for <br />deed has been defaulted by Harstad Companies. Mr. Johnson has reviewed <br />the content of the agreement with Howard M::i.uEi.sto. Mr. Johnson was unsure <br />at this point if Judd Jackson has signed the agreement. <br />Motion made by Miron, seconded by Stoltman <br />Aqreement with Grace Development Corporation <br />site testing at three possible loca`.i.ons. <br />All aye, motion passed. <br />SPECIAL USE . PERMIT NOR i HERN NATURAL_ . GAS) <br />to approve the Soil Borings <br />to allow the City to conduct <br />Northern Natural Gas has applied for a Special Use Permit to expand their <br />existing regulator and meter facility located at the north e�.st corner of <br />State Highway 61 and 175th Street in the City of HUOO. Northern Natural <br />Gas has stated that the increased regulator size is necessary to serve tl <br />increasing natural gas demands of the Community. J'he Hugo Planni.nq <br />Commission conducted a public hearing on June ';'4, 1.99: to consider this <br />request, and has recommended approval. <br />
