value of the home located on the premises and shall name the <br />Lessees as additional insured on such policy. <br />XII. <br />LESSEE DEFAULT AND LESSOR REMEDIES <br />Events of Default. It shall be deemed an "Event of <br />Default" under this Lease if: <br />(a) Lessee fails to perform any obligation of Lessee under <br />this Lease or to observe any other restrictions set <br />forth in this Lease after Lessor gives Lessee written <br />notice of Lessee's failure to perform Lessee's <br />obligation or observe the restriction within ninety <br />(90) days of Lessee's receipt of Lessor's notice; <br />provided, however, that if Lessee cannot reasonably <br />perform Lessee's obligation or observe the restriction <br />within ninety (90) days, Lessee shall not be deemed to <br />be in default under this Lease so long as Lessee <br />commences the performance of Lessee's obligation or the <br />observant of the restriction within ninety (90) days of <br />Lessee's receipt of Lessor's notice, Lessee diligently <br />pursues the performance of Lessee's obligation or <br />observance of the restriction and Lessee completes the <br />performance of Lessee's obligation or the observance of <br />the restriction within a reasonable time period; or <br />(b) Lessee files a petition in bankruptcy, is adjudicated <br />bankrupt, files any petition or answer seeking any <br />reorganization, liquidation, dissolution or similar <br />relief for itself under any present or future federal, <br />state or other statute, law or regulation or makes an <br />assignment for the benefit of creditors; or <br />(c) Any trustee, receiver or liquidator of Lessee or of all <br />or any substantial part of its properties, or of the <br />Premises shall be appointed in any action, suit <br />proceeding by or against Lessee and such proceeding or <br />action shall not have been dismissed within thirty (30) <br />days after such appointment; <br />(d) Subject to Paragraph XIV hereof, the leasehold estate <br />hereby created is taken on execution or by other <br />process of law; or <br />(e) If, Lessee does not use the Premises or cause the <br />Premises to be used for a use permitted in Section 9, <br />Lessor gives Lessee written notice that Lessor <br />considers Lessee's failure to properly use the Premises <br />as an abandonment of the Premises and Lessee fails to <br />use or cause the Premises to be used for a use <br />
