Please see the attached minutes. 7:05 pm Cleannlater Cove Park Dedication Proposal At the meeting of May 13, 2015, the Parks Commission reviewed a concept plan for Clearwater Cove from D.R. Horton. The plan included 89 residential lots. The developer is proposing to construct significant trail connections and sidewalks throughout the development. The developer is also proposing to build a neighborhood park consisting of a play structure and park shelter which would be donated to the City. A proposal has been made to pay full park dedication fees in the amount of $213,600 at the current rate of $2,400 per unit for the 89 unit development. Staff recommends that the Parks Commission approve the park dedication proposal for Clearwater Cove. Please see the attached memo. 7:30 prn Irish Avenue Park Neighborhood Meeting At the meeting of June 10, 2015, the Parks Commission heard a proposal from Steve Hanke volunteering to build a radio controlled car and truck track at Irish Avenue Park. The Parks Commission approved the proposal and offered city support for the initial groundwork and plastic tubing. Volunteers have begun work on the track. There have been resident complaints and resident support of the track. A letter was sent to the property owners adjacent to the park inviting them to share their input at this meeting. Staff recommends that a neighborhood meeting be held to discuss the track. Further direction could be given to the RC Car Track volunteer group. Approval of Minutes from May 13th, 2015 Meeting Pontrelli made a motion, Strub seconded to approve the minutes of May 13, 2015 Parks Commission meeting. Aye: Morris, Pontrelli, Strub, Tennyson, and Schmid Abstained: Windisch Motion carried. II. RC Car Proposal from Steve Hanke Steve Hanke presented a proposal to build a radio controlled car and truck race track and driving area at Irish Avenue Park. The RC cars and trucks would be primarily battery powered with electric motors. Hanke demonstrated how an RC car sounds as it is driven and shared that they are quiet and would not disturb neighbors, horseback riders, walkers, dogs, etc. The hobby is for kids of all ages but primarily ages 10 and up. Because the average run time per battery is 15 minutes, a driver would be at the park for approximately 60 to 90 minutes at a time. The track would be built and maintained by volunteers. It would be temporary and easy to move or re -locate. The suggested track size is 100' by 40' with a practice driving space. Hanke proposed that the track be constructed near the existing parking lot. Hanke asked for support including clearing of the area (4-6 hours of skid steer work), tubing costs (estimated at $300), and future mowing. Windisch made a motion, to approve the use of Irish Avenue Park for a radio controlled car track and provide city support (including initial groundwork and plastic piping) to the volunteers that will build and maintain the track. All Aye. Motion carried. III. Senior Programming Shayla Denaway, Parks Planner gave an update on the senior services and recent invitation for the City of Hugo to serve on the Consortium Lakes Senior Services board. This board helps address services working together and addressing current changes and needs for the seniors. Current programming, services and events include: 1. The Hugo Senior Club offers weekly and monthly meetings from a fashion show, social potluck parties, and cribbage/cards games. 2. White Bear Lake Senior Center offers social events, crafts, community arts/education classes, and several services. 3. Consortium of Lakes Area Senior Services provides community awareness, education, and social events. They are looking for a board representation. IV. Update on Recreation Proarams Shayla Denaway, Parks Planner updated on current/upcoming recreation programs Park Play Days: Tuesdays and Thursdays 9am — 11 am, starting June 9 Tech Tac Toe: July 6-9 Skyhawks Sports Camps: August 3-6 Nature Camp: August 10-14 Tour de Hugo: September 12 The Lions Park informational booth at Good Neighbor Days was steady with residents stopping by to get details on the plans for Lions Park and ask other parks or recreation related questions. Agenda Number:2 CITY OF HUGO PARKS COMMISSION REPORT TO: City of Hugo Parks, Recreation and Open Space Commission FROM: Shayla Syverson, Parks Planner SUBJECT: D.R. Horton. Park Dedication proposal for a residential development to be known as "Clearwater Cove" DATE: August 5, 2015 for the Parks Commission meeting of August 12, 2015 1. BACKGROUND: At the meeting of May 13, 2015, the Parks Commission provided comments on a concept plan submitted by D.R. Horton for a residential development known as "Clearwater Cove". Discussion included the proposed trail design, construction and donation of a park, and a proposal to pay full park dedication through fees. At the meeting of August 3, 2015, the City Council approved the Preliminary Plat and Planned Unit Development (PUD) for "Clearwater Cove". The developer is seeking approval of the Final Plat for phase 1. The Parks Commission should make a recommendation on the Park Dedication requirements to the City Council. 2. DESCRIPTION: The applicant requested approval of a Preliminary Plat and Planned Unit Development (PUD) including 89 single family residential lots and 7 outlots to be known as "Clearwater Cove". The PUD General Plan included 40.5 acres of property rezoned from Single Family Detached Residential (R-3) to Planned Unit Development (PUD). The property includes wetlands and floodplain for a total buildable acreage of 24.9 acres. The remaining 15.8 acres will continue to be zoned R-3 and will be platted as outlots. The properties are generally located south of Frenchman Road (CR 8) and east of Everton Avenue. DR Horton is proposing to develop a portion of two parcels of land, both of which are owned by Marvin LaValle. DR Horton is proposing to subdivide the two -1- Clearwater Cove August 12, 2015 parcels to make the land south and east of the creek the residential development. The remaining land north of the creek will set aside in outlots for future development. The plan shows 89 proposed residential lots, stormwater ponding areas, a park, sidewalk and trail connections, and road connections. 3. PHASING PLAN: D.R. Horton proposed the following phasing plan for Clearwater Cove. The preliminary phasing plan was generally approved by the City Council at its August 3, 2015 meeting. Phase 1 shall include: 1. A 110 foot wide roadway and utility easement shall be dedicated to the City for the portion of Oneka Parkway not within the plat for construction of the road. 2. The park equipment shall be fully installed per plans approved by the City. The 0.47 acres (Outlot F) shall be dedicated to the City. 3. The 8 foot wide bituminous public trail connection from Victor Gardens as shown in phase 1 shall be installed. Phase 2 shall include: 1. The entire length of Oneka Parkway, from CSAH 8 to the development, shall be constructed as an urban section roadway to City standard, with sidewalk and trail, with the first layer of bituminous prior to issuance of a Certificate of Occupancy for the 1 st building. 2. The 8 foot wide bituminous public trail as shown in Phase 2 shall be installed. Phase 3 shall include: 1. The 8 foot wide bituminous public trail as shown in Phase 3 shall be installed. The trail shall end at the cul-de-sac connections. An escrow shall be established with the City to extend the trail to the south plat boundary at the time deemed necessary by the City. 4. PARKS COMMISSION DISCUSSION At the meeting of May 13, 2015, the Parks Commission provided feedback to developer about the proposed trail design, construction and donation of a park, and a proposal to pay full park dedication through fees. Feedback on the proposed trails and sidewalks included relocating some of the sidewalks to the opposite side of the street. The Commission also supported adding a sidewalk so that all of the streets in the neighborhood, except for cul-de-sacs, have a sidewalk. This has been included in the current plans. -2- Clearwater Cove August 12, 2015 The Parks Commission was shown a plan for a centrally located park which would include a shelter and playground. The park would be donated to the City in turn for PUD flexibility. Comments were made about adding parking to the park. The developer feels this would take away from the open lawn play spaces of the park and that parallel parking on the street will be sufficient. This would be similar to Heritage Ponds, Frog Hollow, Oneka Ponds and Arbre Park. 3. PARK DEDICATION REQUIREMENTS: The developer has proposed paying the full park dedication fees. With the current park dedication fee of $2,400 per unit, the developer would be required to dedicate $213,600 for the proposed 89 lots. The developer will be required to pay the park dedication fees prior to the issuance of building permits. 4. STAFF RECOMMENDATION: Staff recommends that the Parks Commission recommend approval of the proposal to pay park dedication fees in the amount of $213,600 with the 89 residential lots of Clearwater Cove. Sec. 90-324. - Park dedication. (a) General dedication standards. In order to develop a system of parks within the community to serve the public's health and recreational needs, a percentage of the net buildable acreage based on the density of all land subdivided for residential purposes shall be dedicated to the city as public parkland. The city finds that the more dense a development is, the more demand for park land it creates since lots can be smaller affording less private recreational space and more occupants per acre. The following formula will be used to determine the dedication requirement where a land dedication is required: Density Percentage of Land to be Dedicated (of the buildable land) 0-3.99 units per acre 10 percent 4.00-5.99 units per acre 11 percent 6.00-7.99 units per acre 13 percent 8.00-9.99 units per acre 15 percent 10.00 < units per acre 17 percent The land so dedicated shall be subject to approval by the city council in accordance with the city's Comprehensive Plan for parks. At the city council's discretion, a parkland dedication fee may be accepted or required instead of or connection with land dedication. The parkland dedication fee shall be set annually by the city council and adopted as part of the city's fee schedule. The parkland dedication fee shall be charged for each dwelling unit originated by the subdivision or development of any property in the city, not including any dwelling unit that may be in existence at the time of the adoption of the ordinance from which this article is derived, or which is subject to an approved development agreement with the city that includes a parkland dedication provision. (b) Appeal process. The parkland dedication fee may be appealed to the city council before the city council makes a decision on the final plat and shall be calculated as follows: The percentage of land to be dedicated will be multiplied by the fair market value of the net buildable acreage. The fair market value shall be determined by the city council, following their review of a current appraisal submitted to the city at the developer's expense. The appraisal shall be made by appraisers who are approved members of the SREA or MAI, or equivalent real estate appraisal societies. If the city receives written notice of a dispute over the parkland dedication fee before approval of the final plat, the developer shall pay the fee into an escrow account pending a decision of an appeal of the fee. If an appeal is not filed within 60 days following approval of the final plat, or if the person aggrieved by the fee does not prevail on the appeal, then the funds paid into escrow must be transferred to the city. BACKGROUND: At the Parks Commission meeting of June 10, 2015, a proposal was presented by Steve Hanke, requesting permission to construct a radio controlled (RC) car and truck race track and driving area at Irish Avenue Park. The Parks Commission unanimously approved the proposal and directed staff to assist with the initial groundwork and provide plastic piping. 2. IRISH AVENUE PARK HISTORY: Property Purchased in 2009 The City of Hugo purchased what is currently called Irish Avenue Park in 2009. Prior to that, the property was home to a gravel pit, rock crusher, and asphalt plant. At that time, re -use of the property included residential development or a possible park. Before the City of Hugo agreed to purchase the property, a neighborhood meeting was held and it was discussed that the property would be planned and redeveloped for active park uses in 10-20 years. Consistent with all other park planning efforts in the City of Hugo, the neighborhood would be invited to participate in the process. Trail Construction in 2010 In the summer of 2010, trails were mowed throughout the park by Hugo Public Works. Former Parks Commissioner Roger Clarke and Steve Hanke helped with planning the layout of the trails. In the winter of 2010-2011, the trails were groomed for cross country skiing by the Hugo Snowmobile Club. The trails provide access to the park for Hugo residents. -I- RC Car Track August 12, 2015 Mountain Biking Trail Proposal in 2010 In 2010, the first summer after the property was purchased, an informal proposal was made to build mountain biking trails throughout the property. The Parks Commission expressed disinterest in having the trails go throughout the entire property and entering into a long-term maintenance and use agreement with Minnesota Off -Road Cyclists. Irish Meadows Proposal in 2011 A proposal was made by Dave Percival and Gary Wilson, representing the University of Minnesota, with their vision for "Irish Meadows". "Irish Meadows" was to be a facility capable of hosting large collegiate cross country invitationals as well as high school and community cross country races. The presentation was also made to the City Council at their meeting of June 20, 2011. The City Council directed that subcommittee be formed to work with Percival and Wilson. Residents near the park property were invited to participate on the subcommittee in addition to Commission representatives. The subcommittee had one meeting after which Percival and Wilson indicated that they were no longer interested in pursuing the project. General Improvements made in 2012 In 2012, the parking lot off of Irish Avenue was expanded to better accommodate the park users. Improved signage was installed to identify the park and inform users of the applicable park rules. 3. RESIDENT INPUT: Councilmembers and Staff have heard from residents regarding the track. Property owners from the three properties immediately south, east, and north of where the track is located voiced concerns. Concerns include noise, disruption of the peace, an increase in park users, lack of input from the neighborhood prior to construction, and not wanting a track in their backyard. There has been input from residents in favor of the track also. Staff has heard from two owners of properties adjacent to Irish Avenue Park that are supportive of the track and plan to use it. Resident comments included that it provides activities to the age of kids that are not interested in other park activities. Councilmember Chuck Haas requested that a neighborhood meeting be held and an apology letter sent to residents adjacent to the property. 4. STAFF RECOMENDATION: Staff recommends that the Parks Commission invite residents to give input and discuss the radio controlled car and truck track at Irish Avenue Park. ATTACHMENTS: 1. He explained that electric remote control cars are becoming popular with 7-14 year olds and that they would like to have an off-street area to use them. The Parks Commission heard and discussed their proposal at their June 10, 2015 meeting. The Parks Commission had concerns about the noise, but the cars were demonstrated to be of low volume. It is anticipated that the average remote control car driver would be at the park for 20-45 minutes at a time. It is anticipated that the current 6-8 vehicle parking lot will continue to be sufficient for park users. As you know, the City of Hugo purchased what is currently called Irish Avenue Park in 2009. However, the park will continue to be open to the public in the interim and temporary uses may be added from time to time. The remote control car track is a temporary use and is dependent on volunteers for reconstruction. We apologize for not holding a planning meeting prior to work being started on the remote control car track. The Hugo City Council takes its promises to residents seriously and hope you will be able to attend the Parks Commission meeting on Wednesday, August 12 at 7:OOpm at Hugo City Hall. As anyone with kids these ages knows, the older they get the harder it is to find activities that they won't scoff at. Kids between the ages of 5-18 need diverse outdoor recreational opportunities, especially family oriented activities. Finding these family oriented activities for 10-15 year old children is extra challenging for parents. RC cars and trucks provide this diverse, family oriented activity; and has high interest with 10-15 year olds. Parents and their kids will buy, budget, build, repair, drive, race, crash, laugh, and compete with each other thru RC cars and trucks. See red square in map below. 5) Community input is crucial In June the Parks Commission decided to move forward with this small project at Irish Ave. Park to offer the families and kids of Hugo another family oriented activity utilizing the great park system in this wonderful city. Most residents of Hugo are not yet aware that this track has been built for their enjoyment and have not had the opportunity to voice their opinion. Since the track has already been built and is ready to use, everyone in Hugo should have the opportunity to check it out. 6) Park Planning and development is sensitive to safety and property value issues With the specific area laid out for the RC track at Irish Ave Park, there should be no safety concerns for other park users. With 120 acres, the track utilizes less than 1 acre of land. The RC cars and trucks will not drive into the tall grass or onto the hiking trails. Property value issues could come from increased traffic and parking lot usage at Irish Ave Park but will not be 100's of people overflowing the intended capacity. Another concern is the noise from the RC cars and trucks for surrounding neighbors and other users of the park (dog walkers, horseback riders, etc.). Electric RC cars and trucks do create some noise (along with the laughter and talking of the driver enjoying the track), however the noise level is very low, less than most vehicles on the roadways. Dogs and horses should not get frightened, especially when using the remaining 119+ acres. For surrounding neighbors, the noise generated should not even be heard at their homes. We could easily test this by running cars on a quiet evening and listening at neighbor's yards. While the majority of RC cars and trucks purchased today are electric, there are gas powered available and these do produce a loud whining sound. These could simply be banned from the track due to noise concerns. In conclusion, the City of Hugo has some great parks and this RC Track is a great addition to a fantastic open park space. An activity that will promote family fun and give the older kids (10+) a fun outdoor adventure. And from my research, the only city owned RC Track in the state of Minnesota! The track has been built and is ready for families and kids in Hugo to enjoy. Let's give them the opportunity. I also suggest several rules to minimize the impact of surrounding neighbors: 1) No gas powered RC cars or trucks. City to place sign. 2) Track hours of operation only while light, no night time racing. Should be open during evening since this enables working families to enjoy with their children.
