Mining Permit - Atkinson Pit <br />Page 2 of 5 <br />6. The inspection fee to cover the inspection costs shall be based on actual costs <br />incurred or as set by Council resolution. <br />7. No change shall be made to the reclamation plan approved by the City for this site <br />without prior consent of the City Council. The permit holder shall maintain on <br />deposit with the City cash or other acceptable security in the amount of $17,500.00, <br />for the purpose of insuring compliance with the reclamation plan. Such deposit will <br />be released by the City upon acceptance by the City Engineer of the reclamation <br />work, or the money may be used by the City to perform the work if the permit <br />holder has not restored the site within one (1) year of the termination of this permit. <br />8. Temporary changes to this permit, made necessary by acts of nature or other <br />emergencies, may be made by the City Engineer. <br />9. Inspections to insure compliance with the Mining Permit will be done by the City <br />Administrator, and he may request the assistance of such other persons or <br />organizations, as he may deem necessary. <br />10. Any violation of the terms or conditions of this Mining Permit may be grounds for <br />immediate termination in accordance with the City Ordinance. <br />11. Haul roads shall be inspected periodically by the City Engineer, and maintained by <br />the contractor, in accordance with the Engineer's recommendations. The City <br />Engineer will have the authority to temporarily close a haul road for use by the <br />permit holder if the road is in such disrepair that it is, or may become, a hazard to <br />the public. <br />12. A maximum speed of 45 mph shall be maintained by the contractor's gravel trucks <br />when operating on the designated haul roads. The permit holder's trucks shall <br />maintain a maximum speed of 30 mph when school is in session. <br />13. Any additional limitations or specifications for the haul roads, which shall be <br />deemed necessary for health and safety reasons by the City Engineer and City <br />Attorney, may be established. <br />14. The hours for the mining operation shall be 7:00 a.m. until 6:00 p.m., Monday <br />through Saturday. <br />15. There shall be no trucking or hauling in of materials before 7:00 a.m. or after 7:00 <br />p.m., except as noted herein, without an amendment to this Mining Permit. <br />OR <br />
