Sprouts Pediatric Dentistry PUD Amendment and Site Plan <br />Page 2 <br />addressed the Planning Commission stating that they designed the building to relate to the <br />commercial buildings in Victor Gardens, using similar materials, colors, and design elements. <br />The Planning Commission unanimously recommended approval of the PUD amendment and site <br />plan to the City Council. <br />2. DESCRIPTION OF REQUEST: <br />The applicant is seeking approval of a PUD amendment and site plan to construct a 4,520 -square <br />foot dentist office building on Lot 2, Block 2, Victor Gardens South Village. The 1 -acre lot is <br />located south of Frenchman Road (CSAH 8) and west of Victor Hugo Boulevard. <br />3. CONTEXT: <br />A. Surrounding Land Use and Zoning <br />The property to the east, south and west are all part of the Victor Gardens development. The <br />surrounding uses in the Victor Gardens development include townhomes to the south and west <br />and a retail center to the east. The property to the north across Frenchman Road (CSAR 8) is also <br />part of the Victor Gardens development and is occupied by commercial uses. All the surrounding <br />properties are zoned Planned Unit Development (PUD). <br />B. Existing Site Characteristics <br />The 1 -acre site has no wetlands and is buildable. The site has remained vacant for several years. <br />There are several scrub trees on the property that will be removed with the development. <br />4. BACKGROUND: <br />In July 2004, the City Council approved a PUD amendment and preliminary plat to be known as <br />Victor Gardens South Village. The final plat was later approved by the Council in September <br />2004. The PUD standards are the same as the PUD standards approved as part of the original <br />Victor Gardens PUD. The approved plat includes 4 commercial lots and 14 townhomes. <br />However, no approvals were granted for the commercial lots. This lot was shown as a bank <br />building on all previous plans. Therefore, the applicant must request approval of a PUD <br />Amendment and Site Plan for the development of a dentist office building on Lot 2, Block 2, <br />Victor Gardens South Village, the last commercial lot in the development. <br />5. ANALYSIS: <br />A. Level of City Discretion in Decision -Making <br />The City has a relatively high level of discretion in approving PUD Amendment. A PUD must <br />be consistent with the City's Comprehensive Plan. The City may impose reasonable <br />requirements in a PUD not otherwise required if the City deems it necessary to promote the <br />general health, safety and welfare of the community and surrounding area. <br />
