Page 11 <br />staff will finalize the technical details as the project moves forward. The system will be installed <br />by the applicant and owned/operated/maintained by the homeowner's association. The system <br />will be part of the overall stormwater management improvements to be included as part of the <br />stormwater permit. A stormwater reuse agreement between the City and the applicant shall be <br />recorded. The agreement will include provisions that will allow the City to operate the system in <br />the event that it is necessary to maintain compliance with the stormwater permit. The provisions <br />will include an ability to assess any City costs associated with operation and maintenance of the <br />system. <br />Staff is working with the applicant to determine whether or not the water reuse system will <br />generate stormwater management credits beyond those required to meet their own permitting <br />requirements. If that is the case, the City will include in its use agreement with the developer that <br />excess credits generated are the property of the City. <br />Wetlands <br />The property includes some wetlands, which have been delineated and approved by the City as <br />LGU. The applicant is proposing to impact 1.3 acres of the 57.7 acres of wetland for street <br />construction. The applicant has submitted a wetland replacement plan to the Technical <br />Evaluation Panel (TEP) for approval of the wetland impacts. The wetland replacement plan will <br />need to be approved prior to final plat approval of any phase. <br />There is a trail network that meanders through the park area shown on the plan. There are a few <br />areas where a boardwalk will be installed for the crossing of the wetlands. The boardwalks will <br />be designed to qualify for a no loss (no wetland impact) determination from the TEP. Staff will <br />continue to work with the applicant on the design of the boardwalk. The boardwalk will maintain <br />the 8 -foot width of the trails they will connect to throughout the development. <br />Homeowners Association <br />A homeowners association (HOA) is proposed for the development. There are three housing <br />styles (single family detached homes, smaller single family detached homes, Villa homes) that <br />are proposed within the development that would have their own homeowners association. All of <br />the homes would be part of a Master HOA will be established for the development to <br />own/operate/maintain community areas, landscaping, and the water re -use system. The HOA <br />would also establish an Architectural Review Committee (ARC) to review and approve the home <br />designs per architectural design guidelines. The HOA documents and the architectural design <br />guidelines shall be reviewed and approved by staff prior to the recording of the final plat for the <br />first phase. <br />Preliminary Plat <br />The preliminary plat consists of 319 residential lots and 10 outlots.
