Planning Commission Meeting November 14,2002-page 2
along the lot line.
Mullner said four pine trees east of the lot line would be removed and the building
would block the view of the future home.
Puleo had concerns about the height of the building, and said there should be
language stating that there would be no other garage permitted on the property.
Puleo made motion, Schumann seconded, to forward the application to the City
Council without a recommendation.
All Ayes. Motion carried.
Orlando Variance
The Board considered the request of James Orlando for three variances to allow
the construction of a 30' X 60' accessory building on his property at 12718 Irish
Avenue North.
One variance would be to locate the building 20 feet from the side property line
where 40 feet is required by ordinance. Staff indicated in the staff report that at the
time the home was constructed, the required setback was 20 feet. In 1999, the
setback was increased to 40 feet; therefore, the hardship was due to a change in
the ordinance and not caused by the applicant.
Orlando was also requesting a variance to permit an accessory building with an
exterior finish that is inconsistent with the principal structure. Orlando was
present at the meeting and told the Board that he wanted to construct the pole
building with maintenance free siding ivory/beige in color. He also stated that he
recently purchased the home and intended to reside the home in the near future
with the same colors as the accessory building.
Also requested was a variance to locate the building in front of the principle
structure on the lot. Staff found that the location of the septic system and the
replacement septic system area prevented him from constructing the building to
the rear of the home.
Other than the applicant, there was no one present who wished to speak on the
request.
Schumann made motion, Puleo seconded, to recommend approval of the variance
for Jim Orlando.
All Ayes. Motion carried.
