9. Park Fee. The City has a policy to build up a <br /> capital account for future park acquisition by means of a park <br /> dedication fee. The Developer has already satisfied the park <br /> dedication requirements through a land dedication which was made <br /> as part of the Development Agreement for Beaver Ponds 1st <br /> Addition. As part of the park dedication requirement, the <br /> Developer shall rough grade the park area. In addition, the City <br /> shall reimburse the Developer for that part of the final grading <br /> in the park area to create a soccer field. Final grading shall <br /> include the addition of topsoil and seed in accordance with City <br /> standards. <br /> 10. Agency Approval. Developer agrees to submit a <br /> plan for drainage and water quality management to the Rice Creek <br /> Watershed District (for its review and approval) , prior to the <br /> final approval of the Plat. Developer acknowledges that no final <br /> plat approval will be given unless the City receives a written <br /> confirmation from the Rice Creek Watershed District that approval <br /> has been given. In addition, Developer agrees to submit the Plat, <br /> or any portions thereof, to all appropriate federal, state, county <br /> or local governing agencies or bodies for their written approval. <br /> 11. Incorporation by Reference.
