The sewer and water system were reviewed in relation to the existing conditions, past <br />development, and the AUAR. The City's Comprehensive Sewer and Water plans can <br />accommodate the study area. The City's Drinking Water Supply Management Area <br />(DWSMA) is located within the southeastern portion of the study area, within <br />development Areas B and C. This area is noted as vulnerable to contamination and <br />development within Areas B and C will be consistent with the City's Wellhead <br />Protection Plan. <br />Storm water management regulations continue to change. The study area is subject to <br />the Rice Creek Watershed District (RCWD) rules, administered by the City of Hugo. <br />The RCWD adopted new rules in 2017. Additionally, Total Maximum Daily Load <br />(TMDL) studies have been completed or are in process of being developed that could <br />affect the study area. These changes are noted in the revised mitigation measure in <br />Section V. <br />Based on this analysis, the area has developed in conformance with the 2002 AUAR <br />and subsequent updates. The areas that are anticipated to develop will be in <br />conformance with the AUAR and updates, and the mitigation measures. The land use <br />plan for the area is based on Option C in the 2002 AUAR. <br />V. Mitigation Summary and Update <br />The mitigation measures developed in the AUAR process are outlined below, including <br />a progress update: <br />1. All permits identified in the AUAR and noted by the commenting agencies will <br />be secured by private properties/developers or the City, as appropriate, for all <br />development areas within the Everton Avenue development area. The permits <br />are listed under Item #8 of the AUAR. Permits were secured for past projects <br />and will continue to he obtained for future projects. <br />2. The City has amended their Comprehensive Plan to be consistent with the <br />information and conclusions of this AUAR, which will guide the permitted land <br />use, zoning, utility extensions, and other development activities. The amended <br />Comprehensive Plan is currently awaiting approval from the Metropolitan <br />Council. The City's Comprehensive Plan was approved by Met Council and <br />this item has been completed. <br />3. The City will comply with its own standards, ordinances, plans, and policies <br />referred to in the AUAR in the review and approval of all development activities <br />within the Everton Avenue AUAR study area. This activity has occurred and <br />will continue to occur. <br />4. Based on EQB rules, the City will update the Everton Avenue AUAR based on <br />Minnesota Rules 4410.3610 Subpart 7 if after five years all development in the <br />Final Alternative Urban Areawide Review Update Page 3 <br />Everton Avenue Neighborhood <br />City of Hugo, MN <br />WSB Project No. 10373 <br />September 2017 <br />
