AMENDMENT NO.2 <br />JOINT POWERS AGREEMENT <br />BETWEEN THE CITY OF HUGO AND THE CITY OF LINO LAKES <br />FOR THE 24th AVENUE/ELMCREST AVENUE AND EAST CEDAR STREET <br />ROADWAY IMPROVEMENT PROJECT <br />THIS 2ND AMENDMENT is made to the agreement previously executed by the City of <br />Lino Lakes on March 11, 2019, and by the City of Hugo on March 26, 2019. <br />It is mutually understood and agreed by and between the City of Hugo and the City of Lino <br />Lakes to amend the previously executed agreement as follows: <br />WHEREAS, the City of Hugo has received indications there may be development interest <br />on a parcel adjacent to Elmcrest Avenue and the City of Hugo therefore wishes to include a <br />bid alternate for the extension of sanitary sewer and watermain to said property; and <br />WHEREAS, all engineering invoices to prepare this bid alternate will be billed to and paid <br />for directly by the City of Hugo; and <br />All other terms and conditions that are not hereby amended are to remain in effect for the <br />duration of the contract. <br />IN WITNESS WHEREOF the parties have caused this Amendment to be executed by their <br />authorized representatives on the date set forth below officers. <br />CITY OF HUGO <br />Mayor <br />Attest: <br />City Clerk <br />Date <br />CITY OF LINO LAKES <br />Mayor <br />Attest: <br />City Clerk <br />Date <br />
