Rice Lake Reserve PUD and Preliminary Plat <br />Page 10 <br />requirements. If that is the case, the City will include in its use agreement with the developer that <br />excess credits generated are the property of the City. <br />Wetlands <br />The property includes some wetlands, which have been delineated and approved by the City as <br />LGU. The applicant is proposing to impact .54 acres of the 21 acres of wetland for street and <br />pond construction. The applicant has submitted a wetland replacement plan to the Technical <br />Evaluation Panel (TEP) for approval of the wetland impacts. The wetland replacement plan will <br />need to be approved prior to final plat approval of any phase. The applicant needs to address <br />several items from WCA Replacement Plan Checklist. Primarily the Technical Evaluation Panel <br />will likely be concerned with the wetland impact from Lot 1, Block 3 and adjacent trail. <br />Homeowners Association <br />A homeowners association (HOA) is proposed for the development. There are two housing styles <br />(single family detached homes and Villa homes) that are proposed within the development. All <br />of the homes would be part of a Master HOA established for the development to <br />own/operate/maintain community areas, landscaping, and the water re -use system. The HOA <br />would also establish an Architectural Review Committee (ARC) to review and approve the home <br />designs per architectural design guidelines. The HOA documents and the architectural design <br />guidelines shall be reviewed and approved by staff prior to the recording of the final plat for the <br />first phase. Each property owners will be responsible for maintaining their own yards and <br />property. <br />Preliminary Plat <br />The preliminary plat consists of 93 residential lots and 3 outlots. Staff has recommended connecting to the existing 12" watermain and extend 12" <br />watermain through the development to Egg Lake Road that meets the goal of the comprehensive <br />water system plan. <br />
